The Board met at the Town Hall at 6:30 p.m.  

SEPTIC PERMITS PEMITS APPROVED:
99 Teele Road – D-Box
348 Sugar Road, Lot 2 - Reissue
Lot 2 – Rocky Dundee – Reissue
84 Sampson Road - Tank

INSPECTION REPORTS:
99 Teele Road - The Board of Health reviewed the inspection report and no failure criteria were noted in the report
7 Teele Road - The Board of Health reviewed the inspection report and no failure criteria were noted in the report
244-248 Harvard Road - The Board of Health reviewed the inspection report and no failure criteria were noted in the report

473 SUGAR ROAD – VARIANCE HEARING – UPGRADE

Present:  Chris McKenzie

Mr. McKenzie met with the Board to request variances to upgrade a septic system at an existing house.  What is being requested is a variance from Regulation 5, distances.  The engineer is proposing to utilize the piping from the old system therefore avoiding re-piping the house.  They are proposing to place the new system in the same general area as the failed system.

After discussion, the board voted to approve the request.

LOT 3, SAWYER ROAD – VARIANCE HEARING

Present:  Craig Martin, Ducharme & Wheeler, Paul Danello and Sharon Murphy, property owners, Mr. & Mrs. Brody, abutters, Boris

Mr. Martin met with the Board to request a variance for the location of the well in relation to the proposed driveway.  The well has already been installed.  What is being proposed is an offset of 2.7 feet, the regulation is 25 feet.  The well cannot be placed in any other area of the lot.  Mr. Martin is proposing a permanent barrier or guardrail to protect the well heard.

Mr. Sprague stated that he feels that the well is too close even with the protection.  Andrea  Gilbert stated that she also feels that the driveway is too close to the well head, even with protect.

After discussion, the board voted to deny the variance as follows:  Rogers – yes, Sprague – no, Gilbert – no.

Mr. Martin asked the board for direction in fine tuning the plan.  Chris Rogers stated that he does not feel that the Board would not entertain an variance for less than 25 feet if the plan presented were a sound one.

After further consideration, the board voted to rescind the vote and allow this matter to be continued to July 25, 2007 at 7:15 pm with the condition that all abutters be notified by regular mail.

46 NOURSE ROAD – VARIANCE HEARING – UPGRADE

Present David Favereau

Mr. Favereau is before the Board to request variances to upgrade the system as there is no place to put a reserve.  By designing this system in this way, he believes this is the better of two evils.  Bill Brookings provided the Board with some background on the site.

Regulation 2 – Reserve Area
Regulation 5 – Distance.  They have 10 foot to slab and 19 to cellar foundation.

After discussion, the Board voted to approve the variances.

A well regulation was also approved.

LOT 33, 55 OAK TRAIL – REISSUE

System installed in 2005, however sign off was not completed.  The permit was extended and expired in the fall of 2005.  Since that date, Title 5 regulations have changed.  Bill Brooks stated that he feels that this board does have authority to resolve this matter.  What would need to be done is an additional port be installed and magnetic tape would need to be installed over the trenches to be in full compliance.  

Andrea Gilbert feels that the developer has made enough of an effort that she feels that the permit can be issued.  Mark Sprague and Chris Rogers agree.  After discussion, the Board voted to sign the new permit.

TOM DENNEY NATURE CAMP POTTY VARIANCE

The Board of Health  reviewed your request for a variance to Camp Code CMR 430.370 that states….. “the operator of each recreation camp for children shall provide at least two toilets or privy seats for each sex….”

Based on the information provided, the Board voted unanimously to grant a variance to allow for two porta-potties with hand washing stations with the understanding that if there are any complaints received by the Board of Health related to the condition or availability of the porta-potties, the Board of Health will rescind their vote and the camp will need to be equipped with the required additional porta-potties.

392 MAIN STREET – DEEP HOLE RESULTS

The Board of Health voted to accept the Title 5 report as presented.

101 WILDER ROAD – LARSON

Inasmuch as the cesspool can not be located, the requirement to crush and fill the cesspool has been eliminate.
