The Board of Health met at Town Hall at 6:30 pm

BUILDING PERMITS APPROVED:
28 Powder Hill Road – Garage Curt Plante
113 Burnham Road – Addition of a bedroom

SEPTIC PERMITS APPROVED:
Sawyer Road – Lot 2
West Berlin Road – Lot 1

LOT 2, SUGAR ROAD – PILEEKI

Mr. Pileeki met with the Board because the Engineering Firm that designed the system will not return his phone calls and he has been unable to contact them.  He is requesting direction on how to handle having the septic system installed and signed off by an engineer that is different from the original design engineer.  After discussion, the Board will confirm with Bill Brookings of NABH as to the necessary procedure and advise Mr. Pileeki.

310 WATTAQUADOCK HILL ROAD

Mr. Dinjian met with the Board to discuss the septic system.  A letter was supplied from Forsite Engineering stating that the system that is in place can support a four bedroom home although the house was originally permitted for three bedrooms.  After discussion, the Board voted to accept the letter and designate the septic system as a four bedroom system.

W. BERLIN ROAD – APPLEVALLEY LOTS

The question before the Board is whether the Taylor property can be subdivided with a restriction on the deed.  The restriction on the deed limits the number of lots on the property be limited to two.  Presently, the Planning Board approved two backland lots and two ANR lots.  After discussion, the Board voted to wait until the Planning Board has an opportunity to further discuss this issue before acting.

159 FOX RUN ROAD

Mr. Ray DeMeo, the prospective purchaser of the property, met with the Board to discuss the number of rooms in the house versus what the house is permitted for.  Mr. DeMeo does not want to have a bedroom deed restriction place on the property.  Mr. DeMeo is the prospective purchaser.  The Board stated that they are limited in what they can do.  As long as the present system is in place, a deed restriction is required.  Should the system be upgraded, the restriction will be released.

After discussion, the Board voted to send correspondence to the present owner and real estate broker stating that based on Title 5 15.002 Definitions under Bedroom, it stated “Where the total number of rooms for single family dwellings exceeds eight, not including bathrooms, hall ways, unfinished cellars and unheated storage areas, then the number of bedrooms presumed shall be calculated by dividing the total number of rooms by town then rounding down to the next lowest whole number.”

Using this definition, the above referenced dwelling would be considered to have in excess of (5) bedrooms.  The sewage disposal works construction permit dated October 15, 1997 indicates a four (4) bedroom dwelling.  Therefore, the system must be redesigned to handle the increased flow or a deed restriction limiting the number of bedrooms to four (4) must be recorded and submitted to the Board of Health prior to sale.

SAMPSON ROAD – MANURE ISSUE/DUMP TRAILER

The Board discussed the continuing issues of manure storage and odor.  Andrea Gilbert stated that she has made numerous site visits, as have all the member of the Board, and she is unwilling to continue to entertain any further dialog on this subject.  After discussion, the remaining members of the Board agreed.
