Board of Health Minutes October 11, 2005

The Board met at the Town Hall at 6:30 p.m.  

Meeting Minutes were read and approved for June 14, 2005, June 28, 2005, July 12, 2005, August 9, 2005 and August 23, 2005.

SDS PERMITS APPROVED:

24 Harvard Road
Lot 13, Drumlin Hill Road
40 Power Hill Road – D-Box Permit

TITLE 5 INSPECTION REPORTS:

159 Fox Run Road – The Board of Health reviewed the inspection report and noted a discrepancy in the number of bedrooms listed.  The property is permitted for four bedrooms.  The Board of Health requested a floor plan of the house be provided or a bedroom deed restriction be placed on the property.  Correspondence will be sent.
296 Hudson Road - The Board of Health reviewed the inspection report and no failure criteria was noted in the report.
36 Nashaway Road - The Board of Health reviewed the inspection report and no failure criteria was noted in the report.
180 Kettlehole Road - The Board of Health reviewed the inspection report and no failure criteria was noted in the report.

730 MAIN STREET – BURNETT

Mrs. Marsha Burnett and her son met with the Board to get an opinion as to whether a deed restriction would be approved on the property, as they would like to build an addition.  After discussion, the Board voted to allow the addition with the requirement that a 4 bedroom deed restriction be placed on the property.

PUBLIC HEARING – 476 MAIN STREET, COUNTRY CUPBOARD

Present:  Mrs. & Mr. Houde, Martha Remington, Craig Martin, Mrs. Kane, Mr. Kane

Mr. Hayes met with the Board regarding an upgrade to the existing system.  As a condition of a possible “subway” sandwich shop, the Board of Health required a Title 5 Inspection be completed.  The system failed.  Before the Board is a request for the following variances:

Distances, system to property line
Foundation offset from system
Out of season test holes


Martha Remington stated that she does not have any objections to the upgrade.  Inasmuch as there are no bedrooms, the flow is based on the use of the retail/business space.  The proposal does protect the water supply for the abutters.

This is an upgrade without any other area to place the system.  One would rather maintain the well offset.  Mark Sprague is requesting that bollards be placed adjacent to the edge of the parking area where the bed is to be placed.  

After discussion, the variances were approved.

PONDSIDE – CRAIG MARTIN

Mr. Martin is before the Board to request that the Septic Permit be issued on the Pondside project.   The Zoning Board of Appeals approved the 40B application on September 22, 2005 with a 20 day appeal period that will expire on October 11, 2005.   After discussion, the Board voted to sign the Septic Permit and hold the permit until the appeal period has expired.  Further, DEP approval of the public water supply well is necessary, the Board will receive a copy of the Condo Documents for their review and approval regarding financial assurance for the proper continuance and monitoring for the systems.  The units will require two bedroom deed restrictions and the Zone 1 radius for the public water supply well shall be marked with blue DEP signs at 50 foot intervals.

LOT 9 – DRUMLIN HILL

Craig Martin met with the Board to discuss  the pump system proposed on Lot 9, Drumlin Hill.  The developer of the property is proposing that the system be installed in accordance with Title 5 requirements, which is less than what was originally proposed.  Mr. Martin is requesting that if the Board looks favorably on this change, that the Board will make the decision effective on the remainder of the lots in Northwoods.  This will eliminate the need to come before the Board in the future on this issue.

After discussion, the Board requested, in writing, a listing of the affected lots and a discussion take place before all Board of Health members.

LOT 7 – DRUMLIN HILL

Northwoods is a FOSBRD.  Currently the well is in the back of the property.  With the way the lot is configured, the only portion of the lot that can be used as a yard is where the well is placed.  The owner of the property is requesting the location of the well be changed.  The new location would not meet the 50 foot offset from property line requirement.

After discussion, the Board voted to deny the request.

24 HARVARD ROAD – MCCARTHY

Mr. Bill Fateiger met with the Board to request variances on a replacement system at 24 Harvard Road.  The system is in failure and is a cesspool.  The lot is a very tight lot with a large area of wetland.  Variances requested are offset from well, distance from roadway.  After discussion, the variances were approved.

571 WATTAQUADOCK HILL ROADFATEIGER

Mr. Fateiger met with the Board to discuss the possibility of finishing off the basement of his home.  There was an addition completed on the house and a passing Title 5 was completed at that time (2001).  There are 8 existing rooms with a 4 bedroom septic system permit.  After a review of the proposed plans, the Board voted to approve the finishing of the basement with the condition that a deed restriction be placed the property.

92 GOLDEN RUN ROAD

Bill Brookings reported that he had made a drive by inspection of the property and the dumpster has been removed.

SAND PIT COMPLAINT

The Board received a complaint of blowing sand by the exit of the sand pit on Route 117.  Bill Brookings made and inspection and found not excessive dust.

EMERSON/SAWYER TREATMENT PLANT

Mark Sprague reported to the Board that four bids were received by the Town and are being reviewed.  A contract will be awarded within 10 days of a decision.

Water tests for 460 Main Street, as requested by the Board of Health
Letter of Intent from Jonathan Mechlin regarding Lot 3, Meadow Road
