The Board of Health met at the Town Hall at 6:30 p.m.  

BUILDING PERMITS APPROVED:              
99 Fox Run – Shed
27 Vaughn Hill Road – Swimming Pool Building Permit
150 Kettlehole Road – Swimming Pool Building Permit

SEPTIC PERMITS APPROVED:
Lot 21 Oak Trail
Lot 11A and 15 Danforth Lane – Reissues

TITLE 5 INSPECTION REPORTS:
70 Nourse RoadThe Board of Health reviewed the inspection report and septic plan and no failure criteria was noted in the report.

409 Still River Road - Jake Jacobson –Mr. & Mrs. Jacobson met with the Board to discuss the Title 5 report that was just completed and it is a conditional pass.  Money is being held in escrow to repair/replace the existing system.  After discussion the Board voted to require the installation of a new D-Box and tank replacement and re-evaluate the flow to ascertain whether the system needs further repair or replacement.

2 CHASE STREET EXTENSIONMATTHEWS

All requirement of the Board of Health have been met except for Bill Brookings to measure the distance from septic to well.  Once completed, Bill Brookings will report back to the Board.  If all information is in order, the Board will accept the Title 5 report.

54 GOLDEN RUN ROAD – GILI

Mrs. Gili met with the Board to ask if she can install a sink in the barn to wash bowls without attaching it to her septic system.  After discussion, the Board will look into the matter and get more information before making a decision.  Chris Rogers asked Mrs. Gili to come to the Board of Health meeting on May 10th.  The Board will contact the plumbing inspector to ascertain whether or not a barn sink must be tied into the septic system.

21 NOURSE ROAD – CALESS

Present:  Craig Martin of Ducharme & Wheeler

In April 2004, Mr. & Mrs. Caless came before the Board to request the Board sign a building permit for an addition on their home.  It was determined that their current system could support a 5 bedroom home, however, as a condition, the Board required a Title 5 be completed.  The Title 5 was a failing report and the system is in failure.  Craig Martin is before the Board to request variances to Regulation 2, trenches; Regulation 5 distances.  They are also proposing to install an impervious barrier.  After discussion, the Board voted to approve the variances as presented.

385 BERLIN ROAD – MCLAUGHLIN

Mr. McLaughlin met with the Board to try and get final signoff for his home. Mr. McLaughlin will need a variance for long sewer lines to be inspected by the homeowner and the destruction of the old well.  The old well has not been destroyed and Mr. McLaughlin would like to use it for irrigation.  The deed restriction form was given to Mr. McLaughlin   Mr. McLaughlin was advised to submit a request in writing and Board will evaluate the flow etc.

PINEHILL, LANCASTER

Tom Christopher of Resource Management, Inc. and Rhona Balco were present for the discussion

Tom Christopher provided an update for the Board and stated that Cheryl Porrier from DEP inspected the site and approved the work.  Lancaster has approved the work and Mr. Christopher is asking the Board for approval so that the project can proceed.  Ms. Balco is asking why the topsoil was not replaced.  Mr. Christopher stated that a bulk of the material was used to cap the landfill.  It is the Town’s responsibility to provide reclaimation of the site and all parties believe this is a positive solution for all.

In response to a Board question, Mr. Christopher stated that the DEP requires testing on short paper fiber because they contain metals.  The levels of metals are way below DEP requirements.  Mr. Christopher stated that the material is tested prior to being put down and is tested again after 6 months and then for a period of two years.  Chris Rogers is requesting that the Bolton Board of Health be copied on all information and testing as it pertains to this property and is somewhat concerned with the long-term impact of this process on the property.  

After discussion, the Board voted to approve the Reclaimation of the site.  Correspondence will be sent to DEP.

475 MAIN STREET – COUNTRY CUPBOARD

Present:  Tim Houde, Dan Campbell, Manager and Scott Hayes

Mr. Hayes is before the Board to discuss the possibility of including Subway Sub Shop in Country Cupboard and why the permit stated that no food could be prepared on the property.  This restriction goes back to 1985.  Mr. Hayes assessed they system taking into consideration the business that are currently in the building as well as the current flows and stated that he feels that it is oversized.  

Dan Campbell stated that the water supply is metered and is between 40-50 per day.  Mr. Hayes will provide more information for the Board.  The hearing was continued until May 10th at 7:00 pm.

72 LONG HILL ROAD – SCOTT SLATER

Mr. Slater met with the Board to request permission to drill a new well.  Their current well is a shallow well with no pressure.  The Board voted to approve Mr. Slater’s request with the condition that the old well be destroyed.

730 MAIN STREET – WILSACK

Present:  Mason Palmer and Mr. Wilsack
Mr. Palmer is before the Board to request variances to upgrade the existing system, which is a cesspool and is in failure.  Before the Board are variances to:  Regulation 3, Groundwater elevations, Regulation 4, percolation tests, Regulation 5 Distances AND Well Regulation 4.1, Well Location.  It is Mr. Palmer’s opinion that the only location to place the system is where it is being placed.

After discussion, the Board voted to approve the variance requests.

HARVARD ROAD – 5 LOT SUBDIVISION – MOSS

Present:  Chris MacKenzie and Mr. Moss

Mr. Moss is before the Board to request the following variances:

Lot 1:  Regulation 3 – Groundwater Elevation - Approved
Lot 2:  Regulation 6 – Ledge – Approved subject to further test holes, Annual inspection by Title 5
Lot 3:  Regulation 3 - Groundwater Elevation Approved  
Well variance request withdrawn
Lot 4:  Regulation 4 – Groundwater Elevation Approved
Regulation 7 Length of Sewer Line – Voted as follows:  Rogers Yes, Sprague, Yes, Gilbert No.  Variance approved conditioned on annual inspection by Title 5 Inspection
Lot 5:  Regulation 5 – Groundwater Elevation – Approved – Reserve area Annual Inspection by Homeowner

This is new construction.  The request for well variance was withdrawn on Lot #3.  The Board is requesting a redesign on Lot 4 with regard to long sewer lines.      

NOMINATION OF ANIMAL INSPECTOR

The Board of Health appointed Phyllis Tower to the position of Animal Inspector for another year term.

HALLMARK PROPERTIES

The Planning Board is requesting input from the Board of Health on the Wattaquadock Hill Road Property.  After discussion, the Board asked that our approval for the shared system be provided to the Planning Board.  

271 BALLVILLE ROAD – DOBECK

Bill Brookings reported that all the conditions the Board of Health required have been completed and a Certificate of Compliance will be issued.

188 HUDSON ROAD – KLEIN

The necessary revised engineering plan was received by Bill Brooking to swap reserve and primary systems and the Permit was issued.

67 GREEN ROAD - ASHE

Manure complaint on Green Road – Ashe/Dunn – Email from Martha Ashe.  The Board will make further inspections and send correspondence to Storbeck/Dunn.

95 KETTLEHOLE ROAD

There is no Board of Health Sign off on the property and therefore should not have an occupancy permit.  Bill Brookings spoke with Frank Krysa regarding this property.  Correspondence will be sent to the interested parties to advise what is necessary to obtain sign off.  

GRANT MONEY

Jeff Boudreau has made a request for information on available Grant money for substance abuse speaker in the school system.  The Board is unaware of any grant money available.

MAIN STREET BEAVERS

After discussion, the Board voted to conduct a site walk on Friday, April 15th and make a determination and report back to the selectmen.

OPEN SPACE SUPPORT LETTER - APPROVED

TOM DENNY NATURE CAMP

Mr. George Watkins is requesting a variance allowing a total of two porta-potties with hand washing stations.   Based on the information provided, the Board voted unanimously to grant a variance to allow for two porta-potties with hand washing stations with the understanding that if there are any complaints received by the Board of Health related to the condition or availability of the porta-potties, the Board of Health will rescind their vote and the camp will need to be equipped with the required additional porta-potties.

53 GREEN ROAD – SULLIVAN

The homeowner has requested to continue to use old well for irrigation and water the horses.  After discussion, the Board voted to allow the Sullivan’s to use the old well for irrigation purposes with the stipulation that the old well can not be tied into the house and cannot be used as a potable source of water.
