The Board of Health met at the Town Hall at 6:30 pm

BUILDING PERMITS APPROVED:
41 Main Street – Cell Tower
564 Main Street – Cell Tower

SEPTIC PERMITS:

Lot 2 Bolton Woods Way – Regan – Transfer - Approved
Lots 2 & 4 - Rocky Dundee Road Subdivision – Extension discussion continued until April 12, 2005 due to the lack of quorum, Chris Rogers rescued
Bolton Senior Housing – Extension – Approved with the certificate of compliance required by 3/26/06

TITLE 5 INSPECTION REPORTS:

719-723 Main Street – The Board reviewed the inspection report and noted it was a failure.  The owner will be notified that the SDS shall be “upgraded” within two (2) years from the date of the inspection or sooner if ordered by the Local Approving Authority (local Board of Health).  Further, the Title 5 Report indicates that the system serves an existing 3 bedroom dwelling and garage.   Page 6 of the report and the permit provided indicates an existing 2 bedroom design flow.  Therefore a two bedroom deed restriction must be place on the property or a septic system upgrade plan which is in full compliance with Title 5 must be submitted which will support the flow from a 3 bedroom dwelling and the garage.

88 Sugar Road  - The Board of Health reviewed the inspection report and septic plan and no failure criteria was noted in the report.
50 Meadow Road - The Board of Health reviewed the inspection report and septic plan and no failure criteria was noted in the report.

360 Long Hill Road – requested information received from inspector and report accepted.

54 GOLDEN RUN ROAD – LAURENE GILI

Ms. Gili met with the Board with regard to gray water questions as she is planning to built a barn for horses and would like to be able to wash her horses.  Presently, there are no gray water regulations.  The Board advised her of what they would require as far a plans and locations when she is ready to file a building permit.  They also authorized Administrative Assistant, Andrea Schnepf, to sign the building permit on behalf of the Board of Health based on the discussion at this meeting.

PINEHILL, LANCASTER – GRAVEL PIT RECLAIMATION

Tom Christopher of Resource Management, Inc. and Rhona Balco were present for the discussion.
Tom Christopher met with the Board with regard to the Gravel Pit owned by Mr. Farnsworth on Pinehill in Lancaster.  The majority of this site is in the Town of Lancaster, with a smaller parcel in Bolton.  Sand was taken from this pit to cap the Bolton landfill.  Most all of the good soil has already been removed from the property.  The reclaimation process consists of using short paper from recycled paper, mix it with sand and then turning it into soil.  This requires a DEP permit to spread the material and the concurrence of the Town of Bolton to proceed with the project.
After discussion, the Board voted to review the information and provide a letter once the members of the Board have had an opportunity to review the information package provided to the Board.

Rhona Balco voiced concern about metals testing at the site and the removal of the existing top soil.  Mr. Christopher stated that they do metals testing and the results are typically lower than the natural soils, with the exception perhaps of copper.  

PUBLIC HEARING – BOLTON BOARD OF HEALTH RULES AND REGULATIONS

Continued until April 12, 2005 at 8:00 pm

NASHOBA VALLEY WINERY - RICH PELLETIER

Mr. Pelletier met with the Board to request that a trailer to house migrant workers for a period of approximately 5 months be place on the winery property.  Mr. Pelletier is suggesting the waste water from the trailer discharge into the tight tank at the winery.  Mr. Pelletier suggested that a “Y” be placed in the PVC piping and tie directly from the trailer into the tank.  

After discussion, the Board voted to allow Mr. Pelletier to place a housing trailer on the property and tie into the existing system, subject to DEP regulations.

63 GREEN ROAD – ELIZABETH BAGDONIS

Ms. Bagdonas contacted the Board of Health for an inspection of her property.  Her neighbors keep horses and she has questions as to the proper housing and disposal of manure.  Bill Brookings of NABH & Mark Sprague did a site inspection on March 7, 2005.  After discussion, it was decided to request that the dumpster located at 53 Green Road be moved 150 feet away from any existing well.

18 CORN ROAD, LOT 2 – BARNWELL

The requested water testing was completed and the results provided to the Board.

COUNTRY CUPBOARD

A request was received by the Board to amend the Food Service Permit.  This matter was placed on the agenda for April 12, 2005 at 7:30 pm.
GROUNDWATER SEASON

The Board of Health voted unanimously to open groundwater season from March 15, 2005 to April 30, 2005.  However, no testing shall be permitted if there is snow in the testing area regardless of the date.

271 BALLVILLE ROAD – DOBECK

The Board reviewed the file.  The Board of Health is aware that the work was completed on the well, however, the Dobecks have not been in contact with Bill Brookings of NABH or provided pictures of this work.  The Board of Health voted to begin condemnation proceedings if this matter is not resolved by their next meeting on April 12, 2005.

2 CHASE STREET EXTENSION

The water tests were received.  The Board is still awaiting the information requested from the pump company as well as a recorded two bedroom deed restriction.  After discussion, the Board voted to require a retest of the well in six months.
