The Board of Health met at the Town Hall at 6:30 pm
SEPTIC PERMITS APPROVED:
Lots 20, 25, 26, 31 and 32, the Oaks – Extension Request TO 2/12/06
TITLE 5 INSPECTION REPORTS:
42 Manor Road – Failure – The Board of Health reviewed the inspection report and determined that the owner has 9 months to repair the system, they must plumb laundry into main system and the laundry discharge must be tied into main system
360 Long Hill Road – The Board of Health reviewed the inspection report and determined that further verification of seasonal high-water information
68 West Berlin Road – The Board of Health reviewed the inspection report and no failure criteria was noted in the report, however a garbage grinder was noted in the report.
104 Sampson Road – The Board of Health reviewed the inspection report an questioned whether the D-Box inspected as required, if so the D-box was not referenced on page 13 of the report. Report is considered incomplete until received
67 Burnham Road - The Board of Health reviewed the inspection report and no failure criteria was noted in the report.
188 HUDSON ROAD – KLEIN
Mr. Klein met with the Board to ask the Board to allow him to swap the reserve and primary septic systems to due cost. At the time the permit was approved it was decided rather than place the burden of the construction cost on the homeowner, it would be on the developer. At this time, the homeowner is constructing the system himself. After discussion, the Board voted to allow Mr. Klein to use the reserve as the primary septic system, subject to updated engineering plans.
70 PINEWOOD ROAD (LOTS 9 & 10) – LONG SEWER LINE VARIANCE REQUEST
The homeowner met with the Board to request a long sewer line variance. Due to the fact that they shifted the house site, the sewer lines are marginally longer then the regulations allow. Since there are no cleanouts in the lines, after discussion, the Board voted to have an annual inspection by the homeowner.
7:00 PM PUBLIC HEARING - BOLTON BOARD OF HEALTH
Present: Craig Martin
As published in the Bolton Common on January 7 and January 14, 2005 this is a Public Hearing to revise the Bolton Board of Health fees for Swine, Rubbish and Tobacco Licenses and amend the Bolton Board of Health Requirements for the Subsurface Disposal of Sanitary Sewage and Well Requirements.
Licenses Fees:
Current Proposed
Swine: $10 $10
Rubbish with Livestock $10 $10
Tobacco: $10 $50
Rubbish: $10 $100
Late fees on Tobacco and Commercial Rubbish Licenses will be imposed at $50.00 per week.
Well Regulations:
Bill Brookings of NABH is asking whether there should be some different ion between irrigation wells and potable wells. After discussion, it was decided that there would be no difference.
4.1 Well Location Requirements
Changes to the well location now include setback from Swimming Pool, in ground or above ground to edge of water was added and easements are now separated out.
6.0 Variances
The wording added was lifted directly from the septic regulations. This was added so that if any variances are requested from the Board of Health, abutters must be notified and notice published.
10.0 – Well Protection
This regulations was moved from the septic regulations to the well regulations, where is makes more sense.
SUBSURFACE DISPOSAL OF SANITARY SEWAGE
Regulation 8 – Shared Systems
Wording to be added that the plans submitted to the Board of Health on a shared system have to be in accordance with the rules and regulations of the various Boards and Committees in the Town of Bolton.
Regulation 10 – Locus Maps
Craig Martin feels that the regulation should be 200 feet from the proposed well or septic system not all lots within 200 feet of the proposed well and septic. After discussion is was decided that if a well or septic is in excess of 150 feet of the proposed systems, a like direction with an arrow and distance would be sufficient.
Regulation 18: Variances
Wording that was approved for 300 feet was included as was approved prior.
The addition of wording requiring more information in the notification and publication, specifically distances.
After discussion, it was voted to approved the change in Board of Health License Fees and continue the discussion on Rules and Regulations until next Board of Health Meeting on February 8, 2005 at 7:00 pm.
EMERSON & FLORENCE SAWYER SCHOOLS
Craig Martin of Ducharme & Wheeler met with the Board to request a variance to Title V Requirements, 310 CMR 15.223(1) Multiple Compartment Septic Tanks.
Cia Ochsenbein was present for the hearing. Ms. Ochsenbein questioned whether it was a good idea to pump any material from Sawyer to Emerson because of the water issues created by the beavers that are now residing in that area.
After discussion it was voted and unanimously agreed to allow the variance.
22 HARVARD ROAD – CUTLTER
Title 5 – Status After review of the file, the Board voted to contact the new owner and advise that there could be no occupancy of the apartment until a new Title 5 report is received. If the apartment is going to be occupied, a Title 5 must be completed within 6 months of occupancy or occupancy must cease.
MANURE COMPLAINT ON GREEN ROAD
After discussion, the Board voted to inspect the properties in question once the weather gets warmer and odor may be present.
