The Advisory Committee met at the Public Library at 7:00 p.m.

CITIZEN’S PETITION – REZONING
Present:  Attorney Deschenes, and property owners Roger and James Kane

The Kane family proposes to develop 28 acres of property running from Interstate 495 all the way across to Route 85 with the exception of the property owned by the Country Cupboard.  Their goal is to develop the property with a grocery store, pharmacy, gas station and coffee shop.  However, some of the property is zoned business and some zoned residential.  A citizen’s petition was filed to request rezoning the property from residential to business which would allow them to achieve the required footage necessary for the proposed development.  Based on feedback following the public hearing the existing citizen’s petition will be withdrawn.  A new citizen’s petition will be submitted that will eliminate the property closest to Route 85 from the proposed rezoning.  

CITIZEN’S PETITION – TREE TRIMMING BYLAW AND TOWN MEETINGS AND WARRANTS BYLAWS

Tree trimming bylaw – This citizen’s petition proposes new language and guidelines to improve upon the removal of dead trees, limbs, and branches in town.  The town has a Tree Warden and currently does clean up in town.  

Town meetings and warrants bylaws - This citizen’s petition is designed to add language to our bylaw which would essentially make it more difficult to have a special town meeting.  The petition also requests that the moderator provide a summary of all the questions to be on a town ballot and what a yes or no vote would mean.  
  
REVIEW OF ANNUAL TOWN MEETING
The Committee reviewed the Annual Town Meeting warrant and voted their recommendations for each article as follows:

Article 1:  Accept Annual Reports – On a motion made by Dinjian and seconded by Abdalian, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)

Article 2:  Additional Capital Share at Minuteman Regional School District – On a motion made by Dinjian and seconded by Benjamin, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)

Article 3:  Fiscal Year 2013 Operating Budget:  The Advisory Committee deferred their vote on the recommendation until next meeting.  

Article 4:  Tree Replacement Program - On a motion made by Dinjian and seconded by Abdalian, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)

Article 5:  Replacement of Self-Contained Breathing Apparatus and Turnout Gear for Fire Department – On a motion made by Dinjian and seconded by Zelenkov, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – abstained, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)

Article 6:  Repair or Replacement of Sugar Road Culverts - On a motion made by Dinjian and seconded by Abdalian, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)

Article 7:  Establishment of Stabilization Fund for Minuteman Regional School District – On a motion made by Dinjian and seconded by Abdalian, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)

Article 8:  Field and Track Replacement Project at Nashoba Regional High School – The sponsor of this article needs to be determined.  The Advisory Committee would like to see the cost of the project in the summary language.  A motion made by Dinjian and seconded by Benjamin to approve this article was withdrawn. On a motion made by Dinjian and seconded by Benjamin, the Advisory Committee voted to disapprove this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  The recommendation in the Annual Town Meeting warrant will read “Disapproved (Unanimous) (The Advisory Committee supports this project and therefore recommends disapproval of this article)

Article 9:  Reauthorization of a Revolving Fund for Web-based Municipal Software Services - On a motion made by Dinjian and seconded by Benjamin, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  

Article 10:  Re-numbering and Revision of the Bolton Administrative Bylaws - On a motion made by Dinjian and seconded by Benjamin, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  

Article 11:  Re-numbering and Revision of the Bolton Zoning Bylaws - On a motion made by Abdalian and seconded by Benjamin, the Advisory Committee voted to approve this article.

Article 12:  Amendment to the Zoning Bylaws to add Section 2.4.3 Line of Sight At Intersection - On a motion made by Abdalian and seconded by Zelenkov, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  

Article 13:  Creation of a Five-Member Conservation Commission – On a motion made by Abdalian and seconded by Dinjian, the Advisory Committee voted to disapprove this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – abstained)  

Article 14:  Fyfeshire Dam  - On a motion made by Dinjian and seconded by Benjamin, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  

Article 15:  Replace Carpeting at Emerson School and Article 16:  Replace Flooring at Florence Sawyer School - It was Mr. Lindsay’s personal opinion that the Town should have the opportunity to vote on the replacement of the carpeting at Emerson School.  Mr. Lindsay was prepared to contact the Bolton’s School Committee representatives to recommend that they submit a citizen’s petition if this article was removed from the warrant.  Supt. Wood and Ms. Federspiel, Chairman of the School Committee stated that if the article was removed from the warrant, they would not go forward with a citizen’s petition this year and would wait until next year for the replacement of the carpeting.  The Advisory Committee deferred their vote on the recommendation until next meeting.  

Article 17:  Installation of Air Conditioning at Florence Sawyer School – On a motion made by Abdalian and seconded by Dinjian, the Advisory Committee voted to disapprove this article.   (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  

Article 18:  Amendment to the Zoning Bylaws, Section 2.5.5.7 Design Review Criteria Article - On a motion made by Abdalian and seconded by Zelenkov, the Advisory Committee voted to approve this article.   (Czekanski – yes, Dinjian – yes, Abdalian – yes, Benjamin – yes, Zelenkov – yes, Rohatgi – yes)  

Article 19:  Amendment to the Zoning Bylaws to Add a New Section 2.5.10 Village Overlay District (BVOD) - Article 20:  Amendment to the Zoning Bylaws, Section 2.3.3 Mixed Uses;
Article 21: Amendment to the Zoning Bylaws, Section 2.3.5.2 Dimensional Schedule; Article 22:  Amendment to the Zoning bylaws, Section 2.3.5.3 One Building Per Lot; Article 23: Amendment to the Zoning Bylaws, Section 2.3.5.6 Building Heights; Article 24: Amendment to the Zoning Bylaws, Section 2.4.1.3 Parking; and Article 25:  Amendment to the Zoning Bylaws, Section 2.5.9.3 Applicability;  Article 26:  Amendment to the Zoning Bylaws, Section 2.6 Definitions; Article 27:  Amendment to the Zoning Bylaws, Section 2.3.4 Use Table; Article 28:  Amendment to the Zoning bylaws, Section 2.6 Definitions, Base Map.  The Advisory Committee deferred their vote on the above mentioned articles (19 – 21) until their next meeting.  

Article 29:  Amendment to the Zoning Bylaws, to add Section 2.5.8 Commercial Solar Photovoltaic Renewable Energy Installations – On a motion made by Dinjian and seconded by Abdalian, the Advisory Committee voted to amend the article to remove the “residential district restriction” and approve as amended.  (Czekanski – no, Dinjian – yes, Benjamin – yes, Abdalian – yes, Rohatgi – yes, Zelenkov – yes)

Article 30:  Amendment to the Zoning Bylaws, Section 2.3.4 Use Table - On a motion made by Dinjian and seconded by Rohatgi, the Advisory Committee voted to amend the article to remove the “residential district restriction” and approve as amended.  (Czekanski – no, Dinjian – yes, Benjamin – yes, Abdalian – yes, Rohatgi – yes, Zelenkov – yes)

Article 31:  Citizen’s Petition – Solar Property Tax Agreement, 125 Still River Road – On a motion made Dinjian and seconded by Zelenkov, the Advisory Committee voted to approve this article.  (Czekanski – yes, Dinjian – yes, Benjamin – yes, Abdalian – yes, Rohatgi – yes, Zelenkov – yes)

Article 32:  Local Historic District Commission – The Advisory Committee deferred their vote on the recommendation until next meeting.  

Article 33:  Article 32:  Citizen’s Petition - Rezoning – The Advisory Committee deferred their vote on the recommendation until next meeting.

Article 34:  Citizen’s Petition – Tree Trimming Bylaw – On a motion made by Abdalian and seconded by Dinjian, the Advisory Committee voted to disapprove this article.  (Czekanski – yes, Dinjian – yes, Benjamin – abstained, Abdalian – yes, Rohatgi – yes, Zelenkov – yes)

Article 35:  Citizen’s Petition – Town Meetings and Warrants Bylaw - On a motion made by Abdalian and seconded by Dinjian, the Advisory Committee voted to disapprove this article.  (Czekanski – yes, Dinjian – yes, Benjamin – yes, Abdalian – yes, Rohatgi – yes, Zelenkov – yes)

ADVISORY COMMITTEE STATEMENT
The Advisory Committee reviewed the Advisory Committee statement prepared by Mr. Czekanski.  Mr. Czekanski will make the discussed revisions for review at the next Advisory Committee meeting.

On a motion made by Abdalian and seconded by Benjamin, the Advisory Committee adjourned at 10:15 p.m.
