Mayor Bertrand called the Public Hearing to order at approximately 7:31 p.m. to receive public input on the above noted ordinance and resolution. There being no one wishing to speak for or against the ordinance or resolution at this time, the Mayor closed the public hearing to continue with the Work Session at approximately 7:32 p.m.
REGULAR CITY COUNCIL MEETING - MONDAY, SEPTEMBER 15, 2008
Mayor Bertrand called the regular City Council Meeting to order at approximately 8:12 p.m. in the Council Chambers of City Hall.ce="Times New Roman" size="+0" color="#000000" style="font-family:Times New Roman;font-size:9pt;color:#000000;">OLD BUSINESS:
1. Council Committee Reports.
Election Committee:
Councilor Lafleur thanked the election workers and City Clerk for their hard work at the September 9 State Primary Election.
Legislation:
Councilor McCue attended the NH Municipal Association Legislative Policy Meeting with over 100 other cities and towns who hashed out recommended floor policies. The help Councilor McCue received from the Council and Planning Board prepared him to effectively deal with the issues at hand.
2. Ordinance amending the Code of Ordinances, Chapter 2, Administration, article III. Boards, Committees & Commissions; and Article VI Administrative Code (tabled 9/02/08)
Be it ordained by the City Council of the City of Berlin, as follows:
That amendments are hereby made to the CODE OF ORDINANCES, Chapter 2, ADMINISTRATION, ARTICLE III. BOARDS, COMMITTEES & COMMISSIONS, Division 1. Generally, Sec. 2-41. Establishment. by adding the Home Health Professional Advisory Board as item 6; and adding DIVISION 2B HOME HEALTH PROFESSIONAL ADVISORY BOARD, Sec. 2-59-Sec.2-61; and amending ARTICLE VI ADMINSTRATIVE CODE, DIVISION 2 Departments and Divisions, Subdivision G, Community Services Department, Sec. 2-342 by adding item 9.
Chapter 2, ADMINISTRATION, ARTICLE III. BOARDS, COMMITTEES AND COMMISSIONS* DIVISION 1. GENERALLY Sec. 2-41. Establishment.
There shall be established the following boards and commissions in the City as required by the laws of the state, the Charter, and by City Ordinances. Appointments to these boards and commissions shall be made by the mayor and approved by the City Council.
(1) Berlin Housing Authority
(2) Cemetery Trustees
(3) Board of Health
(4) Recreation and Parks Commission
(5) Board of Assessors
(6) Home Health Professional Advisory Board
DIVISION 2A - DIVISION 2B. HOME HEALTH PROFESSIONAL ADVISORY BOARD Sec. 2-59. Composition.
The Home Health Professional Advisory Board shall consist of nine (9) members. The membership will include the following;
Three (3) members of the Board of Health,
One registered nurse (preferably a public health nurse, but not a City employee),
A consumer or family member of a consumer
A representative from AV Home Care
A representative from various therapy providers – OT, PT, Speech
Appropriate representation from other professional disciplines to provide expert information as needed
The Community Services Director shall serve as staff liaison.
Sec. 2-60. Term, compensation.
Appointments to the Home Health Professional Advisory Board shall be for a term of three (3) years, and shall serve without compensation.
Sec. 2-61. Powers, duties.
The Home Health Professional Advisory Board shall perform the following functions, assisted by the Community Services Director:
(1) Professional Advisory Board: The Home Health Professional Advisory Board (herein referred to as the PAB) shall advise the Community Services Director with respect to the safety and quality of care, treatment and/or services provided to the clients.
(2) This PAB shall advise the Community Services Director in the establishment and annually review the agency’s policies, governing scope of services offered, admission and discharge policies, medical supervision and plans or care, emergency care, clinical records, personnel qualifications, referral sources and program evaluation. The PAB will advise the Health Division on professional issues, assist in total program evaluation annually, assist the Health Division to maintain a liaison with other healthcare providers in the community, participate in the Health Division quality assessment and performance improvement, reviewing and advising in the development of the agency’s annual budget and capital improvement planning.
3) At a minimum the PAB will meet to assist in the following activities; Annual review and advising on policies, procedures and clinical matters, Annual review and advising in preparing the annual budget and annual capital improvement plan. The PAB will meet at other times as needed.
(4) The Community Services Director shall keep a record of all meeting agendas and minutes

Chapter 2, ADMINISTRATION ARTICLE VI ADMINSTRATIVE CODE, DIVISION 2 Departments and Divisions, Subdivision G, Health Division Sec. 2-342. Same—Functions
Sec. 2-342. Same--Functions The Community Services Director shall perform the following duties:
(1) Supervise, direct and participate in inspecting restaurants, and other food processing, servicing and handling enterprises for cleanliness and sanitary precautions.
(2) Conduct and supervise inspections of nursing homes, foster homes, barbershops, motels, dwellings and all other buildings or establishments to insure compliance with sanitary and es New Roman;font-size:9pt;color:#000000;">Councilor Lafleur moved with a second by Councilor McCue to amend the ordinance by adding the following sentence to section 9: “will work with the Berlin Home Health Professional Advisory Board with respect to matters guiding the department related to federal and state compliance.” So moved, the motion carried.
Councilor Lafleur moved with a second by Councilor McCue to read the ordinance a second time, as amended, by title only. So moved, the motion carried.
Councilor Lafleur moved with a second by Councilor McCue to pass the ordinance, as amended. Roll call resulted in unanimous affirmative votes of Council including Mayor Bertrand who declared the ordinance, as amended, now passed.
3. Resolution regarding the standardization of computer procurement. (tabled 9/02/2008)
Resolved by the City Council of the City of Berlin as follows:
WHEREAS, the City of Berlin has a policy of competitive purchasing practices wherever practicable; and
WHEREAS, the City's purchasing policy also recognizes that in some cases, there is a need for standardization on the purchase of some specialized items; and
WHEREAS, the procurement of computers is one such area where such standardization of equipment is very important because of the need not only to have interchangeable parts on machines, but also to have compatible software and hardware so that the whole system can operate as one compatible network Now Therefore Be it Resolved by the City Council of the City of Berlin as Follows: That the Mayor and Council of the City of Berlin hereby resolve that the City will standardize on Dell® computer equipment and SonicWALL® network security devices/services with respect to the purchase of City computers and ancillary equipment with the understanding that reasonable effort will be made in the purchase of such equipment to obtain competitive pricing on the standardized Dell© and SonicWALL© equipment. Be
it further resolved that such standardization shall expire in three years, September 15, 2011. This Resolution shall be in full force and effect from and after passage.
Councilor McCue moved with a second by Councilor Lafleur to remove the resolution from the table at this time. So moved, the motion carried.
Councilor McCue moved with a second by Councilor Lafleur to amend the resolution by adding “Be it further resolved that such standardization shall expire in three years, September 15, 2011.” So moved, the motion carried.

NEW BUSINESS
4. Ordinance 2008-10: Chapter 6 Fire Prevention, Vacant Blighted Buildings – NO ACTION
5. Ordinance 2008-11: Chapter 18 Code Enforcement, Citation Penalties – NO ACTION
6. Resolution 2008-29: Appropriating a total of $133,839.69 of grants from Fiscal Year 2008 to the Fiscal Year 2009 budget (1st read)
Councilor Lafleur moved with a second by Councilor McCue to table the resolution and schedule a public hearing on October 6, 2008. So moved, the motion carried.
7. Resolution 2008-30: Authorizing the sale of approximately 302 acres of land consisting of two adjacent parcels (Map 402, Lot 24 -205 acres; and Map 402, Lot 27 – 97 acres) of BIDPA land on Route 110 in Berlin (1st read)
Councilor Remillard moved with a second by Councilor McCue to table the resolution and schedule a public hearing on October 6, 2008. Councilor Goudreau refrained from voting due to a possible conflict of interest. So moved, the motion carried.
8 Polling Hours for November 4, 2008 General Election
Councilor Lafleur moved with a second by Councilor Poulin to set the polling hours in all wards for the November 4, 2008 General Election from 8:00 am until 7:00 pm. So moved, the motion carried.
9. City Manager’s Report.
- BOP Sewer & WWTF. The Bureau of Prisons indicate they are considering building their own Waste Water Treatment Facility since they consider it might be more cost effective at this point
- NPDES Draft Permit Comments. A copy of the newly issued permit by the USEPA to operate the WWTF is available for review to determine if there is a reason to appeal any of the new provisions within 30 days.
- Notice of Past Violations. NHDES said the Watson and Shelby Street Pump stations were in violation. Upon review of the back up generators, it was determined these generators could be permitted after all so they are now properly permitted with NHDES.
- Western Avenue Paving. Pike is completing the work.
- Fuel bids. Gorham School District is out to bid with the City of Berlin (schools included) and the Town of Gorham. All previous bids were rejected. New bids due September 24 in Gorham.
- NHMA Action Bulletin. Attached for review. A point of interest is about the state retirement issue.
-Fraser biomass Gasification Boiler. Attached is a copy of the letter from the Cascade Mill to the DES Air Resources Division for the proposed wood chip plant air permit.
-NH Broadband Action Plan. DRED and the Telecommunications Advisory Board plan available for review in Manager’s Office
- DRA Public Forums of Pilot Agreements. October 7 in Lancaster at 2:00 pm.
- Riverfire. October 4 and many events planned. Volunteers still needed.
- Time Warner Cable Notice. Dropping Channel WSBK effective October 10 for more HD programming.
Mayor Bertrand asked the City Manager if the City would get a better bid price if it would not go along with Gorham. The City Manager replied that it could be but they would not know for sure without trying it.
Councilor Lafleur moved with a second by Councilor McCue to file the City Manager’s report and place it on file. So moved, the motion carried.

11. Council Comments:
Councilor McCue mentioned that it is important that the City Planner write to the NHDOT regarding the RT 110 issue. On another matter, Councilor McCue gave the Council a heads-up that at the September 3 Board of Education Meeting the Superintendent mentioned the possible purchase of a school bus and pick up truck.
Councilor Lafleur was approached by the Civics Class teacher again this year to work with the students who will attend a Council Meeting and a staff meeting the following day. He asked if anyone else on the Council would like to participate. Mayor Bertrand said he would like to also participate with the Civics Class.

There being no further business to come before the Council at this time, Councilor McCue moved with a second by Councilor Lafleur to adjourn the regular meeting and go into Non-public session per RSA 91-A:3, II(d) Land Matters. Roll call resulted in unanimous affirmative votes of Council including Mayor Bertrand who declared the regular meeting adjourned at approximately 8:59 p.m.
