City Council Minutes 06/04/2007 Regular Meeting
PUBLIC HEARING - JUNE 4, 2007

- Resolution Increasing the Berlin School Department Budget Appropriation for Fiscal Year 2006/07 by One Hundred Sixteen Thousand, Fifty-Two Dollars ($116,052).
- Resolution Accepting a Grant for One Thousand Dollars ($1,000) from Wal-Mart for Fire Fighting Equipment.  Mayor Danderson called the Public Hearing to order at 7:28 p.m. to accept public comments regarding the above noted resolutions.  There being no one wishing to speak for or against the subject matters, the Mayor closed the public hearing at 7:29 p.m.

REGULAR CITY COUNCIL MEETING _ MONDAY, JUNE 4, 2007
Mayor Danderson opened the regular City Council Meeting at 7:30 pm.  The pledge of allegiance to the flag preceded roll call. Present at roll call: Councilors Nelson, Lafleur, Poulin, Cusson, Roy and Grenier. Councilors Donovan and Danderson were absent.  Also present: City Manager MacQueen, John Moulis, Marion Huntley, Pam Laflamme, School Board Members and the press.

Minutes, Previous Meetings Councilor Roy moved with a second by Councilor Poulin to accept the minutes of the 5/21/07 WS; 5/21/07 Reg.Meeting; 5/30/07 Public Hrg.  So moved, the motion carried.

Disbursements: It was recommended by the Committee on Accounts/Claims that all bills start date 5/22/07; end date 6/04/2007 be paid for a total cash disbursement of: $1,268,392.13 Draft #1542.  Councilor Nelson moved with a second by Councilor Lafleur to accept the disbursement summary and pay all bills as recommended by the Committee on Accounts/Claims.  So moved, the motion carried.

2.      Resolution Increasing the Berlin School Department Budget Appropriation for Fiscal Year 2006/07 by Two Hundred Ten Thousand, Seven Hundred Eleven Dollars($210,711)(tabled 5/21/2007)Resolved by the City Council of the City of Berlin as follows: Whereas the following additional revenues are anticipated:

Now Therefore Be it Resolved by the City Council of the City of Berlin that the sum of Two Hundred Ten  Thousand, Seven Hundred Eleven Dollars ($210,711.00) is hereby appropriated to the School Department; and further, that the above sum is in addition to all other previously appropriated funds for the Berlin School Department Fiscal Year 2007 Budget. This Resolution shall be in full force and effect from and after passage.
- Councilor Grenier moved with a second by Councilor Lafleur to remove the resolution from the table at this time.  So moved, the motion carried.
- Councilor Grenier moved with a second by Councilor Roy to amend the resolution under Medicaid: FY 07 Updated from 106,051 to $155,801, Amount of Increase from $40,051 or 60.68% to $89,801 or 136.1%; Amend Other Local Revenue FY'07 from $22,792 to $67,700, Amount of Increase from $22,792 to $67,700 for a new TOTAL FY'07 Updated from $10,612,462 to $10,707,121, Amount of Increase from $116,052 or 1.11% to $210,711 or 2.0%.  Councilor Cusson abstained from voting.  So moved, the motion carried.
- Councilor Grenier moved with a second by Councilor Roy to have the resolution, as amended, read a second time by title only.  So moved, the motion carried.
- Councilor Grenier moved with a second by Councilor Roy to have the resolution, as amended, read a third time by title only.  So moved, the motion carried.
- Councilor Grenier moved with a second by Councilor Roy to pass the resolution, as amended.  Councilor Cusson abstained from voting.  Unanimous affirmative votes including Mayor Danderson who declared the resolution, as amended, now passed.

3.      Resolution Accepting a Grant for One Thousand Dollars ($1,000) from Wal-Mart for Fire Fighting Equipment. (tabled 5/21/2007)
        Resolved by the City Council of the City of Berlin as follows: That the City Council of the City of Berlin accepts a grant in the amount of One Thousand Dollars ($1,000) and appropriated the funds to the Fire Department for fire fighting equipment and further that the Council authorizes the City Manager to do all things necessary to effectuate the grant.  This resolution shall be in full force and effect from and after passage.
- Councilor Lafleur moved with a second by Councilor Nelson to remove the resolution from the table at this time.  So moved, the motion carried.
- Councilor Lafleur moved with a second by Councilor Nelson to have the resolution read a second time by title only.  So moved, the motion carried.
- Councilor Lafleur moved with a second by Councilor Nelson to have the resolution read a third time by title only.  So moved, the motion carried.
- Councilor Lafleur moved with a second by Councilor Nelson to pass the resolution.  So moved, the motion carried and Mayor Danderson declared the resolution now passed.

4.      Mayor's Report.  
-       Housing Authority Resignation: Paul Cusson.  Councilor Grenier moved with a second by Councilor Roy to accept Mr. Cusson's Resignation from the Berlin Housing Authority. So moved, the motion carried.
-       Housing Authority Appointment:  Paul Croteau to fill Paul Cusson's unexpired term set to expire 12/2010.  Councilor Grenier moved with a second by Councilor Roy to accept the Mayor's nomination of Paul Croteau to the Housing Authority, term to expire 12/2010.  So moved, the motion carried.

5.      Resolution Adopting a Budget and Appropriating Money to Defray the Expenses of Berlin's City Government for the Fiscal Year 2008. (1st read)    
Councilor Grenier moved with a second by Councilor Roy to table the resolution until June 18, 2007.  So moved, the motion carried.

6.      Resolution to Discontinue Completely Success Loop Road from the intersection with East Milan Road to the Milan Town Line, totaling 1.2 miles ("the Road")  (1st read)
Councilor Lafleur moved with a second by Councilor Nelson to table the resolution and schedule a public hearing for July 2, 2007.  So moved, the motion carried.

7.      Other:
Skateboard Event Bill Payment.
Councilor Grenier moved with a second by Councilor Cusson to pay the Police Department $475.00 from the Contingent Account for Police Coverage at last month's Skateboard Event held on Pleasant Street.  So moved, the motion carried.

Fire Department - Local 1088 Contract Cost Item Vote.
Councilor Grenier moved with a second by Councilor Lafleur to approve the following IAFF cost items:

The proposed contract takes the Firefighters from their current 90/10%split on Health Insurance to a 85/15% split for the remainder of this Fiscal Year and to an 80/20% split beginning 7/01/07.
Roll call resulted in unanimous affirmative votes including Mayor Danderson.  The contract was approved.                
8.      City Manager's Report.
- City Web Site.  Info constantly updated to inform citizens/staff about ordinances/meeting notices.
- AVER Annual Dinner. June 14 at the White Mountain Chalet 6:30.  Katie Paine is guest speaker.
- Prison Site Water Quality Certification.  A copy is available for public review.
- BHS Building Trades Home Open House.  June 5 from 4-7 at 24 Tamarack Lane in Berlin.
- Legislation.  Fine Filter Requirements hearing on June 6; SB88-Collective Bargaining opposed by the City and LGC waiting for a House vote; HB143 Apportionment of Damages strongly opposed by the Mayor and Council, Senate voted 15-8 to table the bill.
- 417 Derrah Street. Repairs done by TCC, HUD and RD staff. On June 21, USDA Rural Development State Director to give a check to the City for funds the USDA committed to Berlin in recent years.
- Brownfields Rejected.  Notre Dame Building denied funding.  We will reapply next grant round.
- Mesh Network Project Weather Tower.  Installation work out to bid.  PSNH will install 12 new poles. The Fraser weather tower is being surveyed so proper easements can be accepted by the City.
- Manager's Time.  Attached   
Councilor Roy moved with a second by Councilor Nelson to accept/file the City Manager's Report as read by the City Manager.  So moved, the motion carried.

9.      Public Comments  No public comments

10.     Council Comments - Councilor Lafleur reminded Council that the BHS graduation is 6/08/07 at 3:00.

11.     Adjournment: There being no further business to come before the Council at this time, Councilor Roy moved with a second by Councilor Poulin to adjourn the regular City Council Meeting.  So moved, the meeting adjourned at approximately 7:53 p.m.
