JS opened the meeting.
Continuation – 295 Pulaski Blvd. – Kevin Bradley
Special Permit to allow additional Retail Space

The applicant emailed a request to continue the hearing to January to allow time to put together more information.
AP motion to allow to continue to January 7, 2016 @ 7:00 PM.
JD second.
All in favor to allow a continuation to January 7, 2016.

Special Permit to allow for a Family Apartment

Sitting In:   JS, AP, BS, BW and JD
LR noted all fees have been paid.  Bruce Choquet (BC), applicant and owner stated he would like this permit to allow an addition for himself and his wife.  His son and family would be living in the main house. They would like to help him out financially and as they get older it will benefit them, too.  They have lived there 23 years.  It is a 24 x 32 addition in a suburban zone.  All setbacks have been met.  A plot plan showing the proposed addition was presented.  JK stated he met with BC and advised this placement as there was a ROW issue.  BC stated it will be a single story; L shaped one bedroom addition.  The siding will be in continuity with the existing home. There will not be direct access to the main home.  The board discussed that this may not be a good idea for later years for safety and also so that it cannot be a two family home.  BC stated they would be sharing the deck.  BC stated he has spoken with the BOH and the septic meets the requirements.  There is adequate parking for 7-8 vehicles.  He will keep a buffer of trees, there are wetlands and he is working with the Conservation Commission. There will be a shared electric service and boiler system.   JS explained that they must return in 5 years to renew the permit, if his son moves out or the property sells then this permit is null and void.  If there are any changes to the family members you would have to come back before the board.  This cannot be a rental.  Abutters were in attendance.  Carrie Barrett was concerned that the noise from her kennel would be a bother now that an addition and young family would be living there.   BC stated they are 100’ from her property.  BC said a fence would be going up.  The board encouraged they work out any issues as neighbors since both of their properties and what they are doing is legal.  The board was satisfied with all the information presented to them.  
AP motion to close the hearing.

AP motion to grant the Special Permit for a Family Apartment as stipulated.

All in favor to grant as requested.  There is a 20-day appeal period.

Discussion
Update on Varney Brothers

The board discussed their earth removal permits and that they (VB) should be returning every 5 years.  There was a bond in place previously.  That bond covers any damages to surrounding land, groundwater, etc.  The Building Inspector is supposed to survey the areas. JK will contact Linda Varney and see where they are at with the sale of property, bonds and the current earth removal permits.  

JS explained that JK will be providing much needed support for the ZBA.  JK will guide the applicants; make sure their applications are complete.  He will be full time in office.  LR and JK will be working together on administrative procedures.  JK stated he will be reviewing certain past decisions and following up with the necessary ones.

JD requested the board look at the situation of having the egress between an existing home and a new family apartment.  He feels it is part of the bylaw (Section C & D) of serving the handicap, elderly, etc. JK will follow up with Town Counsel and suggested putting conditions with a Special Permit.
