JD opened the hearing.
New – 5 Pine Acres Drive – Special Permit for Family Apartment
Ed and Michelle Savje
Sitting In:  JD, AP, PD, MarioC and BS
Mr. Sebio, father-in-law to the owners, Ed and Michelle Savje explained he would be building the apartment for Ed’s father. His mother passed away and they would like the dad closer to watch over him as he gets older and may need assistance.  He explained it would be attached with a breezeway, the unit being 24 x 26 with one bedroom.  He stated they did meet the criteria for section 4130.  The property is a single family dwelling and the Savje’s have owned it over 2 years.  They do not need a variance as they meet all the setbacks.  They have town sewer.  He stated there is plenty of parking as they have one extra space and also a garage.  The Savje’s will occupy the current home and Edward Savje, Jr.; Ed’s father will occupy the new apartment.  They will be keeping the structure in line with their own home and others in the neighborhood.  The board explained that this would not be considered a 2 family home if the father was to move out or if they sold it.  There must be a family member living there and if that person changes then they must come before the ZBA once again.  The applicant must come back in 5 years to renew the Special Permit.  You must also bring the decision to the registry of deeds after the 20 day appeal period.  Mr. Savje and Mr. Sebio stated they understood and agreed to follow all the stipulations.

AP motion to close.

AP – Motion to grant the Special Permit as requested.

All in favor to grant the Special Permit for a Family Apartment.  There is a 20-day appeal period.

JD asked for Mr. Jones to update the board on what has been going on.  These are 2 hearings that will be heard together.  Mr. Jones, applicant and owner, stated there have been some meetings to discuss the best action to take.  He can go with the cluster plan or a 5 lot subdivision.  JD questioned if 5 homes would fit in there and Tim Jones (TJ) stated there is enough acreage.  They are just trying to get the parties together and the bank is involved since there is a bond.  The 2 lots w ould be reconfigured and we would add 3 more.  The cluster would give more open space.  Jennifer Ginn of 37 Highridge Road was in attendance to speak on behalf of the neighborhood.  They all have concerns:  water and drainage issues as they all have pumps and very low water pressure, excess water and ice in winter.  TJ said there would be 5 private wells.  PD stated that the board would make a point to talk to DPW with these concerns. All 5 of the lots are agricultural. JD stated that people are used to seeing open space there.  There has been a group of neighbors that are very active and concerned with this project.  There are two options either it’s all built out or it’s a cluster.  TJ would like to ask for a continuance.  He suggested that he could get together with the neighbors to discuss conventional vs. cluster.  The end result will be 5 lots either way.  
AP motion to continue to June 6, 2013 with an extension date to July 18, 2013.

Hearing closed
The draft decision was discussed in length and revisions were made.  Town Counsel stated he would revise this decision and get it to the members and the few items remaining could be discussed at the June meeting.
