MC opened the meeting.
Special Permit Renewal – Richard and Cynthia Allain

Mrs. Allain was in attendance seeking a renewal for her family apartment which was issued in 2004. She stated that the apartment has stayed the same as when it was originally constructed. Her daughter and son-in-law (Tiffany M. and Robert Belanger) are still living there but now with 2 children (Ava and Lola Belanger) . The board reviewed her request and felt she met all conditions to renew the family apartment but required a site inspection by the building inspector that there have been no changes to the family apartment since the original issuance. This is a requirement of the bylaw Section 4133c. Mrs. Allain agreed to that condition and stated she would make an appointment with Mr. LeClaire to go out to the property.
JS motion to grant the renewal for a family apartment pending the Building Inspectors inspection.

The renewal for the family apartment is granted for 5 years. It is the applicants’ responsibility to renew it 60 days prior to the expiration which is February 27, 2017.

MC stated he would be recusing himself from this hearing. JD will be chairing this hearing. The applicant, Mr. Towle and his Attorney, Lee Ambler were in attendance. Attorney Ambler stated his applicant is seeking a Special Permit to allow for a Class II license on the property. The existing structure and land have been commercially used since 1945 as an auto body repair shop and a used car sales business. The applicant is the owner and he is seeking to have 25 vehicles on the property with service to the used car stock only. Mr. Towles stated he has attempted to rent out this property for the same use, but has not had good tenants and feels if he ran a business on his own it would be more beneficial for himself and the neighbors. He stated he always has had a good relationship with his
neighbors and would like to keep it that way. He stated the hours would be Monday thru Saturday, 8:00 am to 6:00 PM; there would not be a spray booth and no auto repairs other than to the autos that he is selling. The board questioned the parking area and felt that a 15 car maximum would be best to start. It is a small lot and it is not always possible to park the cars exactly as laid out. If all went well with this number, as to no complaints then the applicant could come back to the board and seek a higher number of vehicles. The board questioned the wetland area in the rear of the property. The applicant stated that they met all conditions of the conservation commission as their only condition was the fencepost, but the owner chose to put the fence in also. He stated he wants to run a clean, friendly business. A direct abutter was in attendance and stated she never had any problems with the owner over the years just his tenants.
She stated that she though 25 cars were too many. There were also 2 emails read stating the same concerns: parking, cleanliness of property and odors from the past spray booth. Attorney Ambler stated his client met all the conditions for this Special Permit and he would still have to go to the Board of Selectmen for the Class II license. The board considered this request and the hearing was closed.

JD motion to vote in favor of issuing a special permit to allow for a licensed used car lot and servicing of these autos only, no spray painting booth, no storage of auto body chemicals and no more than 15 cars to be on the property at one time.
