826 South Main Street – Special Permit Request
Sitting in:  BA, AP, JS, PD and DC

The applicant Laurie Kirschtel stated she currently owns 5 dogs and is renting the duplex on this property.  Her landlord knows about them and he said it was fine with him when she moved in.  She did not know a Special Permit was required for this many dogs. The Animal Control Officers came when a complaint was issued by her neighbor. A letter was presented by the Animal Control Officers regarding issues that need to be addressed and it was read by the Chairman.  The board felt that they would like to have the officers attend the next meeting so they could discuss their findings.  PD suggested that the applicant try and straighten out some of the issues the officers wrote about before the next meeting.  The applicant agreed to try and do that and requested the hearing be continued until June 5, 2008.

AP motioned to accept the request for a continuance.
MC seconded the motion.

All in favor to accept the request to continue to June 5, 2008 at 7:00 PM.


11 Hartford Avenue

The applicant, Matthew Barnett was requesting a variance.  The hearing was continued from April as the board suggested he seek counsel for this request.  Mr. Barnett presented a cul-de-sac idea instead of the variance request.  The board stated that he had to present only the application and information that was in front of them and he could request a continuance to contact an attorney for further advice or go forward with the variance request.  Mr. Barnett requested to withdraw his application without prejudice.  

JS motioned to accept the withdrawal of the request.
PD seconded.

All in favor to allow applicant to withdraw without prejudice.

40B Lakeview Estates Update

JS explained that the 40B project was still in the hearing process.  The applicant appealed the decision and then we filed a motion to dismiss based on the housing count from DHCD.  JS stated that the board did behave within the law at that time regarding the decision.  The next step is to go forward for a motion to reconsider. Beth Haines, a resident asked about the status with the 40B project and the conservation commission.  JS said he would speak with them.

Pearl Street Decision
MC questioned the deed restriction that was to go in the Pearl Street decision the board recently put together.  BA stated he spoke with Town Counsel and the applicant is to put it in his deed restriction and present that to the Building Department before any building permit can be issued.  MC would like to have the full board review any decisions before they go to the Town Clerk.  JS felt that Attorney Ambler could defend the decisions if he needed to.  Some of the board members felt it would be a long process to wait for all members to review the decisions.

Discussion
AP asked about an overdue invoice of $12, 253.93 to Duetsch, Williams and Brooks, our 40B attorney.  JS is to check with Attorney Rich Hucksam and get an update.

There was a letter that went out requesting that if any board officials see more than one unregistered vehicle on a property would they report it to the Zoning Agent as it is getting out of hand.  MC asked that in the future if any correspondence goes out by the Zoning Board of Appeals that the whole board should be aware of it beforehand. The board members agreed.

PD seconded.
