Attorney Antonellis, representing the applicant, explained that his applicant received a foundation only building permit for a duplex and that the building inspector knew of the unique situation on this property and now after researching chapter 40A he is not able to issue a full building permit. Attorney Antonellis stated that certain lots are protected. It is zoned suburban and duplexes are allowed. He asked the board overturn the decision of the Building Inspector.
JS motioned to overturn the decision of Mr. LeClaire, Building Commissioner.
MC seconded the motion.
All opposed to overturn the decision of Mr. LeClaire.
Attorney Antonellis then requested a variance to allow for the construction of the duplex as the uniqueness affected the build-ability. The board questioned as to why the applicant would not just put a single family home on the lot. Mr. Antonellis felt the foundation was already there and the uniqueness is due to how the lot was created. There was discussion that the Charles River is a right of way and if this is the case then there would be a clear divide. The board would like an opinion in writing from Town Counsel. Attorney Antonellis agreed and requested a continuance to April 3, 2008 at 7:00 PM.

High/Maple Street

Attorney Antonellis, represented the client. There was discussion on the density of tree buffers (handouts were presented), lighting, which is to stay consistent with what the board saw at the property they visited (Stonehill College), time limits (10:00 PM closing), roof shape, building color and that any changes of use must come back to the ZBA. The applicant requested a continuance to draft a decision showing all the points of discussion. The board felt this would allow time for town counsel to review and comment, along with the board members so a final decision can be reviewed at the April 3rd meeting.
MC made a motion to accept the request for a continuance.

Discussion
The board discussed the new procedure of advertising and accepting applications for all vacant appointments. Dawn Davies, Selectwoman was in attendance and explained she felt all residents should know of the opportunities available and be able to apply. PD was concerned how that would affect the alternate members, who may have sat in, listened and gained knowledge over many years possibly waiting for a permanent board position. Ms. Davies stated all members, alternate and permanent would have to come before the Board of Selectmen when their appointments have ended.
