The board felt that after speaking to Town Counsel the applicant needed to apply for a variance for lot frontage which was not stated on the application. Attorney Roche represented the applicant and felt that their original request for a Special Permit under sections 2310 and 2570 could be granted under the grandfather rights of the bylaw. They applicant agreed to continue so that the board could get clarification on Section 2570 in writing from Attorney Ambler.
MC – motioned to accept the request

12 Pearl Street-Jeremy Ballerino

Attorney Antonellis represented the applicant. He stated that he felt a duplex was allowed in this zone, agriculture, under 40A Section 6, as long as it was not held in any common ownership with any adjourning land. He stated his applicant is allowed to go to this bylaw before we have to go to section 2530 of your bylaw and we are asking for you to allow you to let your zoning agent continue with the building permit process. The board felt that they would like to read more into this section and would also like to see that the lot was owned individually at the time. Attorney Antonellis said he would get the title examination that was done and certified to prove separate ownership of the lot. A continuance was requested.

41, 45 and 51 Pulski Blvd. & 100 Salisbury – Jolicouer and Chariette

The board had seeked a second opinion from Attorney Hucksam and it was determined that the applicant did not have a single lot under section 2300 and felt a variance request was needed. Attorney Lasorsa represented the applicant stating that when he read Attorney Moody’s letter it stated that the Special Permit could be issued if the board felt it was not substantially more detrimental. The board felt that it is a new building and not just changing the use. The 3 lots were originally pre-existing non-conforming and grand-fathered and the board felt that you can not get one large grand-fathered lot when you combine them. The board felt they should apply for a variance if it was determined that section 2310 would not apply here. JS said he would get the opinions from both attorneys after
giving them the facts from this hearing and get the results writing. Attorney Lasorsa withdrew the application without prejudice.
MC motioned to accept the withdrawal without prejudice.

High Street/Maple Street

Attorney Antonellis presented the detailed proposal of the sports complex requesting special permits for outdoor recreational use, for the height of the building of 60 feet and for the height of the lights. The board requested the applicant have the traffic study with a comparative analysis, to arrange a site trip to see a complex with similar height and capacity that is currently in operation, the noise mitigation and also information on moving the building deeper into the ground for possibly lessening the height issue. The applicant requested a continuance for one month.
MC motioned to accept request.
PH seconded.
5-0 in favor to accept the request for a continuation to February 7, 2008 at 7:00 PM.
