The hearing for this Special Permit request was continued from last month to get an opinion from our Town Counsel. Mr. Ambler presented an opinion in writing for the board to review. The board did review the information and discussed the pre-existing non-conforming structure, the garage, which is being proposed. The board questioned if this change would not be substantially more detrimental than the existing non-conforming structure or use to the neighborhood. Some of the board members drove by the property and felt this proposed project would be an improvement to the neighborhood. There we no abutters present at the hearing. The applicant stated this was not for re-sale of the home but just for their own personal use. The bylaw, section 2310 and chapter 40A-section 6 was discussed.
There was disagreement as to the interpretation of this bylaw.
AP motioned to close the hearing.
MC seconded.
All in favor to close this hearing.
AP motioned to grant the special permit as requested not to exceed 18 feet as indicated.

The Special Permit is granted as requested. A proposed plan was presented to be attached to the decision.

40B Project
JS, liaison for the Lakeview Estates Project gave an update. The board suggested a meeting with Jan Gould, counsel for this project, at the next regular scheduled meeting in October. JS will set it up.
