Selectmen Minutes 10/19/2015


                                                October 19, 2015


The regular meeting of the Board of Selectmen was called to order by Chairman Soter at 7:00 PM with all members in attendance except Mr. Martinis.

Public Hearing – Hunan Kitchen, Inc.
Mr. Soter explained this public hearing with Hunan Kitchen is being held to discuss the establishment’s sale of alcoholic beverages to a minor during a compliance check performed by the Police Department on August 7th.
Mr. Chi-Ming Chang, Manager appeared before the Board.  He stated on the night in question, he was working both the bar and kitchen.  He stated he was the one who served the minor and apologizes for this violation.  
Mr. Mayhew asked Mr. Chang his percentage of eat-in meals to take-out.  He stated his business is about 80% take-out.  Mr. Mayhew stated this leaves 20% of individuals who could purchase alcohol with their meal which equates to a very small margin for error.
Mr. Spencer asked Mr. Chang how many years he has been in business.  He stated approximately 10 years and has never had a violation in that time.
Mr. Spencer asked Mr. Chang if he will be taking extra steps so this does not happen again.  Mr. Chang answered in the affirmative.
Mr. Connor stated after reading the report, the violation is very clear.
Mr. Soter stated he is more apt to place Mr. Chang under a strict probation rather than suspend his license.
Mr. Mayhew also agreed with probation for the first offense with a letter placed in Mr. Chang’s file.  If this were to happen again, a suspension would take place.
Mr. Connor stated he would not support probation.
Board members advised Mr. Chang to card everyone, no matter their age.
On a Mayhew/Spencer motion, the Board voted to place a letter of admonishment in Mr. Chang’s file for this first offense and a three-day suspension of his license if a repeat violation were to take place.
Mr. Connor opposed; all other members voted in the affirmative.

Town Common Trustee Application
Mr. Ernest Pelletier submitted his application to serve as a Town Common Trustee.  He stated he served on the original Town Common Feasibility Committee and then served on the Town Common Committee.  
The Town Common Trustees voted unanimously on Oct. 13th in support of Mr. Pelletier’s appointment.
On a Mayhew/Spencer motion, the Board unanimously voted to appoint Mr. Pelletier to fill the unexpired term on the Town Common Trustees.

Treasurer/Collector Appointment
Mr. Fraine stated he asked Mr. Shaun Strobel to attend the Selectmen’s Meeting this evening to ask for the Board’s ratification of Mr. Strobel’s appointment as Treasurer/Collector.  Mr. Fraine stated he had a third interview with Mr. Strobel on Friday afternoon.  He believes, along with Mr. Laviolette, that Mr. Strobel is the best suited candidate to fill the Treasurer/Collector vacancy.  
Mr. Soter and Mr. Connor also attended the interview on Friday and feel Mr. Strobel has excellent qualifications for this position.
On a Mayhew/Connor motion, the Board unanimously voted to ratify Mr. Fraine’s appointment of Shaun Strobel as Treasurer/Collector with starting date of November 30th and appointment running through June 30, 2018.

On a Mayhew/Connor motion, the Board unanimously voted to accept the October 5th minutes as submitted.

On a Mayhew/Spencer motion, the Board unanimously voted to award Contract 2015-MSD Clara Macy School Building Demolition to the low bidder, Southern Middlesex Industries, Inc. of Norwood, MA not to exceed $656,666.00.

On a Connor/Spencer motion, the Board unanimously voted to appoint James Kupfer as Assistant Building Commissioner for Zoning.
Mr. Fraine stated this position will be strictly for zoning issues.

On a Mayhew/Spencer motion, the Board unanimously voted to adjourn the meeting at 7:45 PM.
