Cliff Matthews opened the continued hearing and stated that the applicant has requested another continuation to May 9th at 8:00 PM in order to address the redesign of the proposed basin that resulted from discovery of high groundwater discovered during soil testing at the basin site. The board voted unanimously to continue the hearing to May 9 at 8:00 PM

Cliff Matthews opened the continued hearing and stated that the applicant has requested a continuation to May 9th at 8:30 PM in order to give the applicant ample time to address the high groundwater issues discovered during soil testing at the location of the proposed basin as well as other information relating to drainage as requested by the Commission previously. The board voted unanimously to continue the hearing to May 9 at 8:30 PM.

Matthew Fasolino and Paul DeSimone were present at the opening of the hearing. Mr. DeSimone presented the revised plan for the development of the site for a mulch business. He stated that he included

detail on the concrete block wall located on the western boundary of the site. The resource area boundaries and were reviewed and erosion controls were inspected by the Commission at a site walk on Sat. March 31st.  Mr. DeSimone stated that trap rock is proposed at the entrance of the site and that ¾ inch stone is to be placed on the balance of site to prevent erosion and minimize dust. Mr. Fasolino stated that this business will only be open seasonally, in the spring, summer and autumn each year. Cliff Matthews stated that the concrete block wall proposed at the western side of the property must be inspected and maintained continually throughout the business season each year so as to avoid sediment transport onto the abutting conservation restricted property. He also stated that the erosion controls must also be maintained throughout the seasonal business. Mr. DeSimone stated that Mr. Fasolino has agreed to install a fence on the Army Corp. boundary of the property and will also install a fence to protect the resource area on site. He suggested that after installation of the fence, the haybales would be installed behind the fence and be maintained in good condition and renewal each year, if required. There were no further comments. The Board voted to close the hearing and issue an Order of Conditions.

Mr. DeSimone then requested that the Commission give him some guidance in filing the Notice of Intent to address a second Enforcement Order issued on the Mechanic Street property owned by Henry Wickett in August 2010. The board scheduled an informal inspection site walk for Sat., April 14th at 8:00 AM.

John Finley and abutter, John Tessier, were present when Cliff Matthews opened the hearing for a proposed septic repair. Mr. Finley stated that the repair is for a five bedroom dwelling and will include a 1500 gallon tank, grease trap, a pump that will direct flow to a distribution box then to the leach field. The leach field design includes an impervious barrier. EcoTech Inc. delineated the resource areas that were confirmed by Conservation Commission Administrator, George Holmes. Mr. Finley stated that there is no disturbance proposed within the 25 foot buffer and that erosion control is proposed within the existing fence located in the back yard. The Board of Health has approved the septic design. Roger Tessier, the abutter, stated that the house should never have been built in l988 because it does not have sufficient frontage on Brisson St. He stated that he still pays taxes on the paper street. He was also concerned with the protection of the resource areas and the related wildlife and the existing septic tanks on site. Cliff Matthews stated that the conservation commission jurisdiction includes the protection of resource areas and that it appears that the site has sufficient information to prove it is a valid lot. Mr. Finley added that three new tanks would be installed and that Mike Graf would certify the elevations as the system is being constructed. Mr. Finley would also be supervising the construction.  He stated that he would then create a certified as built plan for both the Board of health and the Conservation Commission that adhered to the Plan of Record. There were no more comments or questions.  The board voted unanimously to close the hearing and issue an Order of Conditions.

Corrections to the minutes of the meeting of March 14th were discussed. Corrected minutes will be sent out for approval at the April 25th meeting.

Cliff Matthews stated that the Board of Selectmen has requested that the commission meet at the municipal center. Because public hearings have been advertised and scheduled until May 9th and abutters have been notified of the current location, the board agreed that it would meet at the new location for the first meeting in June.

Cliff Matthews reported that the DPW had to hire a contractor to remove the dam at Crystal Lake at Silver Lake. According the Don DiMartino, the DPW had planned on removing it but the project was too large. The contractor did not adhere to the Order of Conditions as the work was not done in a no flow period and the contractor had to utilize dewatering practices that were not permitted. There is some siltation downstream that must be removed by the DPW when no flow conditions occur in the near future.

Because of the lateness in the month and lack of availability, no one from the commission is able to plan an Earth Day clean up.

Anne Matthews will contact Don DiMartino again on the status of the repair of the Pulaski Boulevard basins that were improperly constructed.
