Peter Lavoie of Guerriere & Halnon was present when Cliff Matthews opened the hearing. Mr. Lavoie stated that the filing is for the proposal to construct a single family dwelling near Crystal Lake on Silver Lake Road. The proposal includes buffer zone disturbance of 7638 sf in the 25-50 foot buffer zone and 14,876 sf in the 50 -100 foot buffer zone. The plan includes the preservation of the 25 foot no disturb zone that runs parallel to Crystal Lake. Mr. Lavoie stated that he located erosion control measures and staked out the proposed dwelling, septic and driveway in the field as shown on the plan. Cliff Matthews stated that the Commission would like to eliminate some of the proposed tree cutting so as to preserve shade for the bordering vegetated wetlands resource area at Crystal Lake. Cliff asked Peter to check into
reconfiguring the frontage at abutting Lot 11 and also to consider sharing a driveway with Lot 11 in order to eliminate tree cutting. The Commission was very concerned with the proposed cut and grading at the rear of the house because we did not want to see another groundwater breakout problem as was the case at Lot 8 when severe grading took place. Mr. Lavoie offered to conduct test pits on Friday to obtain groundwater elevations. He would also design a subdrain if necessary. Mr. Lavoie said that the deepest cut would be eight feet into the bank behind the dwelling. The Commission scheduled a site walk for Saturday, March31 at 8:00 AM to review the delineated wetland boundary, to check the proposed erosion control location, to see the house location and property line at the rear of the site, and to evaluate the proposed grading and tree cutting. Mr. Lavoie said that he would provide test pits evaluation and the requested frontage information and lot layouts for the abutting lots
to the Commission. By unanimous vote, the hearing was continued to April 25th at 8:30 PM.

Attending the hearing were Austin Turner, Bob Frazier, and Tom Sexton. After the continuation was opened, Austin Turner stated that at the last hearing, the Commission had expressed a desire to conduct additional test pit and soils work on the site in order to better evaluate the site conditions. He stated that he has scheduled the work for next week. The applicant will contract with Miller Engineering who performed work on the site in the past. Mr. Turner then presented an exploration plan proposing that
five of the six infiltration basins would have additional testing performed. Infiltration basin #4 will not be tested again since the applicant has already agreed to raise the basin bottom elevation. The Commission requested that George Holmes contact Mike Graf to request his availability to witness the testing. Mr. Turner stated that the five additional witnessed test pits would take place on day one (to confirm current information) and drilling of 3-4 additional borings would take place on day two. Tom Sexton stated that he was pleased that the additional testing would be conducted. Austin Turner will coordinate the schedule with George Holmes early next week. By unanimous vote, the hearing was continued to April 25th at 7:30 PM.

Cliff Matthews opened the continued hearing. Michael Yerka was present. Mr. Yerka presented a recorded and signed subdivision plan date 10/9/2008 from the Planning Board that accurately reflects that the subdivision for the site has been approved by the town. He stated that the proposal is for three existing structures to connect the sewer line. The additional duplex would require a separate Notice of Intent filing with the Commission. The sewer line will be horizontally drilled, will be encased in concrete and will be constructed in dry season. There were no additional comments from the board. The Commission voted unanimously to close the hearing and issue an Order of Conditions. Mr. Yerka will pick up the permit at Inspectional Services on April 16th,

Peter Lavoie and peer reviewer, Tom Sexton, were present when the hearing was opened. Lori Fafard, a Commission member, recused herself as she is an abutter to the project. Peter Lavoie stated that the proposed sewer line would be constructed on Douglas Drive, cross wetlands then be located within the proposed roadway for Lakeview Estates, crossing to Dupre Road, connecting to the pumping station on Cross Street and then to the Center Street sewer line for disposal at Woonsocket. The sewer would service the newly proposed 40B project “Lakeview Estates”, portions of Scott Hill Acres, and existing dwellings along the previously named streets. He stated that the sewer line is a mitigation measure for Lakeview Estates as required by the 40B ZBA permit. He stated that 30% of the gravity sewer would be installed in the
roadway and calculated approx. 1,500 sf of resource area impacts. The Commission will also check to confirm that the resource areas delineations continue to be valid. Cliff Matthews asked
that the wetland crossing methodology be submitted for the culvert crossings located on Crystal Lake and at Dupre Road since the information was not included in the filing. Tom Sexton remarked that the Dupre Road work will be in groundwater and that an eleven foot cut is proposed. He added that dewatering issues must be addressed. The Commission also noted that the culvert at Crystal Lake is in need of replacement and that detail should be provided to address the construction of that culvert. Tom Sexton requested that all resource areas be located on the plans including intermittent streams, flood plain, riparian zones, 25 & 50 foot No Disturb Zones and Estimated Habitat. He added that the plans with resource areas be submitted in 20 scale for ease of reading. Mr. Lavoie stated that DEP and the DPW have approved the sewer
line as proposed and that he would provide that information to the Commission. Cliff Matthews gave Peter Lavoie a copy of the peer review contract for the project. Peter will give the contract to Fafard and provide funding as requested. By unanimous vote, the hearing was continued to May 9, 2012 at 7:30 PM.

The Commission will contact Leo Dalpe on the status of the land donation, stormwater bond and Certificate of Compliance for Pine Acres on Wrentham Road.
Cliff reported that a student from Bridgewater State would like to certify s few vernal pools in Bellingham. George has corresponded with her.
