Attending the hearing were Bob Frazier, Austin Turner, and Tom Sexton. Cliff Matthews opened the continued hearing, he stated that item SWM7d pg 23 (poly liners in detention basins and additional test pits at basin 4 and raising the basin bottom three to four feet) seems to be addressed. Item SM3 pg 24 (2 inch orifice in the basin), the applicant still needs to provide revisions to the maintenance plan and provide additional recommendations/opinions that these orifices will function properly. Austin Turner said that Stormwater Compliance LLC has been engaged by the applicant to look at the maintenance information and provide feedback. Mr. Turner then stated that a meeting was held on Dec14th meeting with Tom Sexton and representatives from TetraTech. He presented handouts consisting of tables and mapping relating to a compilation of information gathered from test pits borings, test wells and groundwater elevations. At that time, Tom Sexton also handed out his response to three of the tables and mapping and presented his concern that more information must be gathered to present more realistic seasonal high groundwater elevations.  The balance of the meeting was focused on analyzing the information that was presented. Because of inconsistencies and data interpolation, Cliff Matthews stated that the applicant should really revisit the site and locate test wells, gather groundwater elevation information and present without reasonable doubt that the results are scientifically based. Mr. Turner said that he has not been out on the site for at least a year but agreed to the request. Cliff then also stated that the Commission should also visit the site once the wells are located in order to get a better understanding of the topography. Tom Sexton added that Dave Albrecht has already said that the basin elevations would be changed to 217.5 but the presentation made this evening had basin bottom elevations of 217. After Bob Frazier agreed, Austin Turner said that he would sent out the well mapping to Barry Lariviere who would then be able to locate the wells with a GPS unit on site. Mr. Turner stated that the applicant or his representative would accompany the Commission when the site walk is conducted. The Commission set up a tentative site walk for Sat. Jan. 28th at 8:30 AM and hoped that there would still be no snow cover. By unanimous vote, the hearing was continued to January 25, 2012 at 7:30 PM at which time the Category II issues as defined by the applicant’s representatives would be discussed.
Anne Matthews asked Bob Frazier to check with the status of the complete Certificate of Compliance for Charles River Center. Once the Certificate is recorded at the Registry of Deeds, the balance of the replication bond will be released to the applicant. Mr. Frazier will advise.

Michael Yerka was present when the continued hearing was opened. Cliff Matthews stated that he spoke with Health Agent Michael Graf about the Title V issues and that Mr. Graf stated that there may be some confusion with interpretation of the regulation. Mr. Graf wrote in his email to the Commission that a sewer connection is not an alternative system as it has no bearing on section 15.286. He writes further that the confusion on 15.004 emerged with Title 5 in that a septic system could not be constructed in a Zone 2 unless recommended by the Board of Health. Cliff said that DEP utilized Bellingham’s Water Resource District as the basis for creating the Zone 2 in town. Cliff then stated that he also spoke with DEP who agreed with the Conservation Commission’s approach of looking at soil samples and weighing the resource area impacts of the sewer connection to the impacts generated by construction of the individual septic systems. Mr. Yerka stated that he had performed a couple of soil tests that morning. The holes were seven feet deep and dry; however the soils are stratified sand and gravel. When asked what the commercial building would become, Mr. Yerka said that he did not know until the applicant went to the Zoning Board. It was his belief that it may become a small coffee shop. Mr. Yerka then presented the detail on the horizontal pulling connection illustrating that no “dip” in the casing would occur under the brook. He stated that the work would occur in a period of low flow and that there would really be very little loss of vegetation with the construction. Mr. Yerka was instructed to speak with Don DiMartino and the City of Woonsocket on the feasibility of the project as this was a condition for issuance of a permit. He was also instructed to get Board of Health recommendations for the commercial use. The Board voted unanimously to permit the sewer connection. Mr. Yerka requested that the hearing be continued to February 22nd at 8:30 PM at which time he should have all other information requested. By unanimous vote, the hearing was continued to Feb. 22nd at 8:30 PM

Tim Jones is presenting a subdivision proposal for 5 lots on Highridge Road to the Planning Board on Jan. 12th. The Commission reviewed the proposal and was pleased about the addition of an additional 12 acres (a connection between two Conservation Commission parcels) of open space.

The Annual MACC Conference will be held March 3rd. Commission members were urged to submit workshop preferences to Anne Matthews for expeditious processing.

George Holmes reported that Larry Levey, Sr. Property Mgr for Chestnut Hill Condominiums submitted a copy of a letter to the Commission regarding the maintenance proposal for the basin at the condos submitted by Tucker Landscaping of Ashland MA. Tucker has proposed that the work take place in August 2012 and then annual maintenance of the basin thereafter.

The Commission is awaiting the status on Toll Bros. resolution to the trespass issue at Bellingham Estates. All maintenance work has been performed as per Eric Renzi of Toll. As soon as all work is completed and all issues addressed, the Commission will schedule a final site walk for the issuance of the Certificate of Compliance.

Neal Standley and George Holmes are liaisons for the project located at 323 Lakeshore Drive. Mr. Czesmesia has begun pouring his foundation.
