Allen Orsi and Lauren Hastings of Pare and Don DiMartino, DPW Director, were present when the hearing was opened. Mr. Orsi stated that the concrete and stone weir at Crystal Pond (a shallow body of water about 130 feet long) has failed and must be removed per Office of Dam Safety even though the size of the pond is below the minimum threshold. The work will be done during a period of no flow. He said that the proposal is to remove, chip and demolish the weir to the existing channel. As part of the completion, rip rap will be installed on the upstream side of the culvert and concrete blocks will be installed on either side of the pond outlet to provide structural stabilization. Ms. Hastings then stated that wetland impacts will be less than 700 sf. consisting of alteration to bank, land under water bodies, bordering land subject to flooding and riverfront area. She stated that the impoundment effects from lowering the pond by three feet will only make the area become more riverine in character and will have no wetland losses because the basin should interact with groundwater.  Don DiMartino stated that it would take about one day to perform the proposed work. Mr. DiMartino said that he would supervise the work. The Commission requested that the project plans include installation of haybales on the downstream side of the weir to mitigate degradation of water quality. Mr. Orsi said he would include the revisions in the plans. The project would be accepted as a limited project under the By Law and, as such, the WPA standards are sufficient to address the criteria in Section 10.03:(7)(c)2.j.  Motion was made, seconded and
voted unanimously to close the hearing, issue the Order of Conditions and *sign the Order of Conditions at the convenience of the Commission members. *This is due to conflict with Special Town Meeting and the requirement to issue the permit within 21 days.

Brian Stonkus and Walter Lewinski were present when the hearing was opened. Mr. Lewinski stated that the applicant filed the Notice of Intent to address the flooding that currently takes place from runoff from the abutting property and Mill Street. The proposed project includes work in the buffer zone to BVW and is also located within the Riverfront Area to the Charles River. Mr. Lewinski proposes to address the offsite flooding by installing a landscaped earth berm directly in front of the existing building at 12 Mill St. An 8 inch drain pipe would then direct stormwater from the front of the building to a concrete channel draining off from the east side of the site to a rip rap check dam and outlet structure. Mr. Lewinski also proposed to remove some paved concrete parking spaces on the sides of the building and loam and seed the area to provide additional recharge. He stated that roof infiltration is already recharging roof run off from the building. Commission members were concerned with the proposed concrete channel stating that it will just increase velocity and volume of the stormwater and not mitigate for water quality. It may also present maintenance issues.  Cliff Matthews then stated that the board members should walk the site. A site walk was scheduled for Sat., Oct. 2nd at 8:00 AM. The hearing was then continued by unanimous vote to Wed., Oct. 27th at 9:00 PM.

Conservation Commissioner, Brian Norton (an abutter) recused himself from the hearing. Kevin Lobisser, Mark Allen and a few abutters (see list) were present when the hearing was opened. Mr. Allen stated that the project began in the 1980’s when 84 condos were permitted. The applicant proposes to change the original plan and construct only 21 more units (seven buildings) with associated septic system and stormwater management. The applicant is proposing 23 acres of deed restricted open space of the 35 acre parcel and a stream crossing is no longer proposed. The project has been presented to the Planning Board and Graves Eng., Planning Board peer reviewer. Mr. Allen stated that the applicant proposes to utilize the existing road and utilities (electrical, water and sewer) but reshape the existing cul de sac to construct the seven new buildings each housing three units. Mr. Allen stated that the existing facility has no stormwater

management system because it was built in the early 1980’s. The proposed stormwater system located on the driveway entering from Mechanic Street consists of eight catch basins and one forebay in each of the
two basins.  A 2:1 rip rap slope is also proposed to the west of the buildings that also includes a drainage swale with under-drain at the bottom of the slope. An existing 28 foot wide asphalt driveway is proposed to be reconfigured to an 18 foot wide paved driveway (for emergency purposes) that would connect the existing condos with the new buildings and access road. Mr. Allen said that the water would run down this new driveway hitting a crown in the cul de sac and then be directed into the two proposed catch basins at the bottom of the driveway. Cliff Matthews was not convinced that two catch basins and crown in the cul de sac would adequately address stormwater. Board members stated that the stormwater could potentially flow directly into one of the proposed dwellings. The Commission reminded Mr. Allen that the roofs of the new seven buildings should all have roof leaders for infiltration.  Mr. Matthews then noted that the Bylaw has just been approved and that the buffer zone is now a resource area. He said that the applicant should quantify the impacts to the buffer zone and should also provide alternatives and mitigation for those impacts. He stated further that the 25 foot no disturb zone was only a policy in the past but is now included in the by law. Mr. Matthews said that the Commission should first re-verify the wetland boundary and asked the applicant to confirm that the flags are all in place. He also mentioned a violation on the abutting property that may also be taking place on the Crystal Springs property. A site walk was scheduled for Sat., Oct. 2nd at 8:30 AM. By unanimous vote, the hearing was continued to Wed., Oct. 27 at
9:25 PM.

The minutes of the meeting of August 25 2010 were accepted.

The Commission signed:

After some discussion, the board voted not to sign the Certificate of Compliance for 105-236/38 Maple St. Scandia Kitchens until a Form 8A is completed and as built plans are submitted for review.

The Board voted to hold a special meeting on October 6th at 7:30 PM to discuss regulations.

Cliff Matthews presented the open space proposal from the applicant at Oak Hill in Wrentham. Cliff will contact the applicant to request more information (plans, information from Natural Heritage on records keeping for the Eastern Box Turtle, and detention basin location).
