Approval of Minutes The minutes from 1/27/09 were reviewed. Mr. Forte and Mr. Fleuette made small changes to the wording of the content. Mr. Fleuette motioned to accept the minutes, Ms. Arnold seconded the motion and the Board voted unanimously.
OLD BUSINESS
Hilltop Farms The Board discussed the recent court hearing in regards to the Hilltop Farm tobacco violations and inconsistencies in documentation gathered by the State Tobacco Officer. Mr. Fleuette motioned to eliminate the Hilltop hearing on February 24th due to the result at the court hearing and the documentation inconsistencies; Ms. Arnold seconded motion and the Board voted unanimously.
Agent Graf stated that the Board can request a new inspector. Mr. Fleuette reiterated that the presence of Sarah McColgan, the Tobacco Control Director, is needed to appear before the Board to assure trust in the process and confidence in the system. The Board would like to have Ms. McColgan appear at our next meeting.
Mutual Aid Agreement Agent Graf stated that Town Administrator, Denis Fraine, said he had approved the Mutual Aid Agreement. The Board is now awaiting the agreement to be reviewed and approved by Town Counsel. Agent Graf will send another email to Town Counsel to move the approval along.
Health Agent Review The Board confirmed that all reviews from each member were received and were given to Agent Graf for review. Agent Graf acknowledged receipt and confirmed review of each report. The Board decided to have all reviews put on to one report for the next meeting.
Food Inspection Fees Agent Graf stated that Town Administrator, Denis Fraine, wanted Agent Graf to do all of the food service inspections. Mr. Fleuette stated he has a meeting set with Mr. Fraine for Wednesday, February 11th. Mr. Fleuette requested the Board have Mr. Fraine come to the next meeting. The Board agreed to table the discussion of Food Inspection Fees until that time.
NEW BUSINESS
Hilltop Trash Complaints The Board reviewed trash complaints against Hilltop. The Board reviewed the fine issued by Agent Graft along with photos of the trash.
CORRESPONDENCE
The Board reviewed and acknowledged the following correspondence: FY09 Budgets, Finance Committee Liaison List, Excavation & Trench Safety Regulations, Aerial Application to Control Mosquito Larvae, and MCDBG Grant Application.

Mr. Forte motioned to pay the following bills, Mr. Fleuette seconded the motion and the Board voted unanimously:

HEALTH AGENT REPORTS
The Board reviewed and acknowledged the inspection reports.
PLANS FOR REVIEW
59 Box Pond Road Brian Cook, owner of 59 Box Pond Road, and Mike Catalone from Inline appeared before the Board for the approval of two variances. The plans were reviewed by the Board. Mr. Forte motioned to accept the two variances for 59 Box Pond Road to reduce the septic tank foundation from 10’ to 6’; reduce leachfield setback to wells from 100’ to 51’; reduce leachfield to property line from 10’ to 5’; and reduce septic tank from 50’ to 35’; Mr. Fleuette seconded motion and the Board voted unanimously.
ADJOURN
Ms. Arnold motioned to adjourn the meeting at 8:55 pm, Mr. Fleuette seconded, and the Board voted unanimously to adjourn.
