ZBA Minutes July 28 2011
The Zoning Board of Appeals of the Town of Avon held a meeting on Thursday, July 28, 2011 at the Avon Town Hall.  Present were Messrs. Drew, Ladouceur, Eschert, Johansen, Ms. Hard and Mr. McCahill, Planning & Community Development Specialist.  Mr. Drew called the meeting to order at 7:30 p.m.

PUBLIC HEARING                                                                    July 28, 2011

The Clerk read the call to meeting.

Mr. Drew read the Application of Peter E. & Heather T. Lindley, owners, Peter Lindley applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 25’ variance from the 30’ rear yard set back requirement to permit a 12’ x 20’ shed to remain, located at 44 Sylvan Street in an R-30 zone.

Mr. Peter Lindley was present.  He said when they purchased this house there was an old shed there that was infected with insects, they tore it down and replaced it with a smaller aluminum shed which has become too small.  They are now looking to put in a 12’x20’ shed which needs a variance.  He went to the Assessor’s office to have them change the value on this new shed and that’s when he was told he needed a variance and a building permit.  The town is the property  owner behind this piece.  There is a 50’ CL&P right of way and a 50’ drop off the back of his property to the town garage.  It’s actually 35’ to the drop point from the back of the shed.  The present smaller shed will be removed.  It had been closer to his neighbor than the new proposed location.  He has been moving dirt toward the back of the lot to shield the commercial properties.

Mr. McCahill said for the record that the property directly behind this is the town of Avon public works facility and to the south of that is Skip Wheelers property.  The issue here is he abuts a commercial zone, so from the town’s perspective there’s no concern with this shed as we can’t see it from our property, unfortunately he can see some of our messes from his property.  

There was no one else present except John Eschert.  The Public Hearing closed at 7:45 p.m.

ZONING BOARD OF APPEALS MEETING                                     July 28, 2011

A Zoning Board of Appeals meeting was held following the Public Hearing.

Mr. Eschert made a motion to GRANT, seconded by Mr. Johansen the Application of Peter E. & Heather T. Lindley, owners, Peter Lindley applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 25’ variance from the 30’ rear yard set back requirement to permit a 12’ x 20’ shed to remain, located at 44 Sylvan Street in an R-30 zone.  The vote was unanimous by Messrs. Drew, Ladouceur, Eschert, Johansen and Ms. Hard.

Reason – To grant variance is in harmony and keeping with the purpose and intent of the regulations and would not be injurious to the neighborhood.

Hardship – To deny would deprive the owner of a reasonable use of the property.

There being no further business the meeting was adjourned at 7:44 p.m.
