The Chair calls the meeting to order. The Pledge of allegiance is recited.
Agenda Item 1: Minutes of April 6, 2010 and May 4, 2010
As there is not a quorum for the minutes of April 6, 2010 they are held until the next regularly scheduled meeting.
Chair asks for a motion to approve the minutes of May 4, 2010. So moved by Anne McCarthy, seconded by Anthony Bartolotta. All members vote approval. Motion carried.
Agenda Item 2: 87 Orchard St.: Application for a Minor Site Plan Review to utilize an existing building and site for the purpose of selling pre-owned vehicles. Applicant: Alfred Elardo, Jr. (tabled from April meeting).
Chair invites the applicant to speak.
Alfred Elardo Jr. - 98 North Fulton St., Auburn, NY
He is leasing the building to be able to sell 3 to 5 cars at the maximum. Not to make a living, just to pay for the lease. He is retired from the State after 28 years, and needs to keep busy. He realizes that it is a tough area, but has had no problems as of yet.
Chair opens the public hearing.
Mike Milillo - 92 Orchard St., Auburn, NY
He has lived on Orchard Street for 82 years, right across from 87 Orchard St. The property was going downhill, but now there is a big improvement with the grounds being kept clean and grass being mowed. His wife has been on the Neighborhood Watch for 20 years with Arlene Ryan. The addition of this business will not hinder or distract negatively on the neighborhood, and will be better for the community.
Chair closes the public hearing and asks the Board for comments.
John Breanick – Asks what is the NYS law concerning how many you can sell in a year.
Stephen Selvek – Annual limit over 6 cars a year would need a retailer’s license.
John Breanick – The aerial view has 3 different sections: Alfie’s Auto Sales, and the Roundhouse are on either end, what is in the mid-section?
Stephen Selvek – That is under the control of the property owner for construction materials. It was a dumping ground of sorts.
John Breanick – What about the section with the Roundhouse?
Stephen Selvek – Same applies. Also, that area is under the enforcement of the APD and AFD.
John Breanick – Do you have a copy of the lease?
Stephen Selvek – Not with me. There are concrete barriers.
Frank Reginelli – Rear property owners – trespassing?
Stephen Selvek – A triangle lot next door will have fencing along property line. The applicant has no responsibility according to his lease.
Frank Reginelli – The property as a whole…are the people protected?
Andy Fusco – There are fences; they aren’t the best, and it is very steep terrain. Property behind the Roundhouse is a party area and they leave trash, etc. and it is not part of….
Frank – I’m more concerned with the people of Orchard Street
Andy Fusco – Residence on Orchard Street.

Stephen Selvek – The liability is not passed on to the lessee in the lease….

Stephen Selvek – it’s an active issue. One week with cooperation or longer without.
Anne McCarthy – questions maximum number of vehicles
Stephen Selvek – average parking area of 18 x 60. Enough for 6 vehicles, plus POV plus anyone on the premises for business.
Sam Giangreco – asks for staff comments.
Stephen Selvek – Type 2 action under SEQR. Applicant is using site in existing condition providing needed maintenance and clean up. Applicant has stated no new lighting will be installed. There will be the required DMV sign only. A four foot concrete sidewalk needs to be repaired. Lawn area is to remain. Privacy fence along the eastern property line for required buffer. Staff recommends approval of the annotated site plan noting that a maximum of 6 vehicles will be displayed and no vehicle shall be parked on the lawn area abutted to the residential district.

Agenda Item #3: 131 Grant Ave. Application for a Major Site Plan Review and SEQRA Lead Agency designation for the construction of a new 8,000 SF Family Dollar Store and site improvements. Applicant: Rocklyn Supply Company.
Chair invites owner or applicant to speak.
Greg Sgromo from Dunn & Sgromo Engineers here with Art Kanerviko from Rocklyn Supply. There is an aerial view with the site laid on over it so you can visualize what is going on with the project and what is surrounding it. There is also a revised site plan showing a driveway 2 feet wider than originally done with a sidewalk along the northern edge of the driveway. The building is 8000 SF with the entire site being about 1 acre. I believe the submitted site plan meets all City Codes relative to parking, landscaping, etc. Lighting: there are 3 lights on the site; 1 at the driveway, 1 at the front of the store and 1 at the side of the store. Lighting plan will be provided. Storm water basin on site to keep water levels the same or lower than current. Drainage patterns will be maintained as existing.

John Breanick – questions the last time a traffic study was done
Stephen Selvek – last one remembered was for Kentucky Fried Chicken/A&W restaurant. One issue brought up by the Design Review Committee is driveway curb cuts along the area and the impact of traffic. As part of the review under SEQR we will be coordinating with DOT and have asked for any comments or insights with regards to traffic patterns. This is a preliminary look at the site plan, more of a sketch plan review. The DRC has begun reviewing this and will be spending time for a more in depth review to give the applicant what he requires to continue.
John Breanick – questions left hand turns
Stephen Selvek – we are not prepared to make any recommendations at this time. APD has requested comments from DOT for this area now & in the future. We can request studies as warranted.

Anne McCarthy – there are other businesses there that make left hand turns off of and onto Grant Ave
Stephen Selvek – we can’t penalize this developer for anything that may happen in the future. Decisions are for existing conditions.

Stephen Selvek – DRC concerned with traffic impact and storm water management where further detail is needed. Also lighting and signage. The lighting issue was spoken of tonight. Looking for additional detail for signage as it does come under the purview of this Board for review. The required landscaping has been provided along Grant Ave but more is required around the perimeter of the parking area.
Art Kanerviko – Code allows us 200 SF sign on the building. We are looking for a 144 SF sign and 70 SF on the pylon which is also below the allowable.

Stephen Selvek – we’ve covered everything in SEQR that I had. We will be continuing our review for any other details that need to be covered. Unlisted action under SEQR. Staff recommends coordination of SEQR review with DOT as an involved agency re: issuance of a highway work permit as well as approval of the curb cut for that area. Draft resolution declaring this Board as Lead Agency has been set forth. Recommendation is for approval of this resolution and then tabling site plan review until the next meeting on July 6th.
