Business Meeting

Roll Call – Councilors Graney, McNabb, Dempsey and Mayor Lattimore, present.  Councilor Smith – absent.

Staff Members Present – Mark Palesh, City Manager; Michele McNabb, Deputy City Clerk; Lisa Green, Comptroller; John Rossi, Corporation Counsel; Gary Giannotta, Police Chief; Jenny Haines, Planning Director; Michael Hammon, Fire Chief.

All stood for the Pledge of Allegiance to the Flag.

Mayor Lattimore asks for a moment of silence.

Public to be Heard

Tom McKellop, 32 Lake Ave. – Spoke to council about active aging week taking place between Sept. 22 and Sept. 30.   Free to age 50 and older.  He gave a brief overview of the week’s events.

Mary Lou Picciano, 32 Cayuga St. – Spoke in opposition of the resolution to amend the council rules and procedures in regards to the public to be heard.

Bob Janis, 25 Chestnut St. – Spoke to council in regards to issues with codes. He has concern with city council minutes not being posted online in a timely manner.  Would like the city to make a better effort to notify citizens regarding streets being closed for the East Genesee reconstruction.  He is also opposed to changing the public to be heard portion

Barrie Gewanter, Syracuse ACLU- Spoke in regards to the public to be heard session of City Council. She is opposed to the wording in the resolution that is being brought forward tonight.

Rick Colavito, 9 N. Marvine Ave. Spoke in opposition of the resolution regarding changing the public to be heard session of City Council.

Charles Mace, 151 Quill Ave. – Spoke to council regarding the public to be heard portion of the City Council meeting.  He would like to see people have more respect when they get up to speak.  

Cherry Love Duncan, Auburn - Spoke to council regarding the public to be heard portion of the City Council meeting.  She would like to see more jobs in Auburn.  Suggested that council should possibly look into enacting a curfew in the City.

Tom Gabak, 146 Washington St. and President of CSEA – Spoke to Council in regards to the Rules and Procedures for the City.  He suggested we don’t change the current policy, just enforce it.

Presentations and Proclamations

David Sikora, Town of Sennett  - Spoke to council regarding the subdivision of East Side Heights.  He asked Council to adjourn to an executive session for 5 minutes so that he could discuss issues that involve contract negotiations and can’t be discussed in a public forum.  Council agreed.

Council adjourned to executive session at 6:45PM and returned at 6:55PM

Mr. Sikora thanked Council for their support.

City Managers Report

Mr. Palesh reported on the following:

·       The City will be receiving grants from New York State for regionalizing Water and Sewer Service and Fire Service.

·       The governor has agreed to sign Senate Bill 329 regarding multi family homes.  He thanked Councilor Smith for his efforts in regards to this issue.

Ordinance #18 of 2007 authorizing amendment to the Auburn City Code Chapter 297, entitled “Water Service”.  Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Passed




Resolutions

Council Resolution #183 of 2007 authorizing changing work hours at City Hall from 9:00 a.m. to 5:00 p.m. to 8:00 a.m. to 4:00 p.m. year round commencing Tuesday, September 4, 2007.  Council discussed the hours with Mr. Palesh, City Manager and Lisa Green, Comptroller.  Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – no.  Councilor Smith – absent. Defeated

Council Resolution # 184 of 2007 authorizing the City Manager to advertise for bids for the supply and installation of L.E.D. Obstruction Lights on the Tower at 85 Osborne Street, Auburn, New York. Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Passed

Change Order Resolution #185 of 2007 authorizing the Mayor to enter into Change Order #1 with Natare Corporation of Indianapolis, Indiana, in the amount of $11,832.00 to furnish and install a stainless steel gutter system for the Casey Park Swimming Pool Renovations 2007, to be charged to Account #HA 7143-440-EY.  Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Passed

Appointment Resolution #186 of 2007 authorizing appointments to the Auburn Beautification Commission.  Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Passed

Local Law
~
Local Law #9 of 2007 authorizing amendment to the Auburn City Code adding a new Article to Chapter 285 entitled “Impounding and Towing”.  Police Chief Giannotta explained the “boot” to council.  Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Passed

The Mayor closed the public hearing regarding Local Law #10 of 2007

Local Law #10 of 2007 amending Local Law #1 of 2007 approving and accepting the Auburn Empire Zone Development Policy.  Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Passed

Tabled Legislation

Council Resolution #182 of 2007 amending the Rules and Procedures for City Council of the City of Auburn, New York to require that any person wishing to speak at the Public to be Heard portion of the Council meeting, sign an acknowledgement that they have read and understood the rules and state they will not violate the rules as stated.  Motion to Table by Councilor McNabb seconded by Mayor Lattimore Vote:  Councilor Graney, McNabb, Dempsey, and Mayor Lattimore – aye.  Councilor Smith – absent.  Tabled

Other Business -  The Mayor congratulated last year’s Auburn High Football team on their championship and hopes that they do as well this year.   He would like to see the signs put up recognizing the team on their State Championship.

Councilor McNabb commented on the condition of the bleachers and benches at the Y field.  He would like staff to look at the condition of various benches throughout the City.

Council adjourned to executive session at 8:45PM and returned at 9:00PM.
