Business Meeting
Roll Call – Mayor Lattimore, Councilors Jacobs, McNabb, Hunter and Dempsey; present.

All stood for the Pledge of Allegiance to the Flag. Bill and Ellen Clarke and their children Janica and Austin lead the pledge using American Sign Language.
Presentations and Proclamations –
Mayor Lattimore introduced Dave Smith, President of Nucor Steel in Auburn. Mr. Smith announced that Nucor was donating funds for the city to place a land based skating rink at Hoopes Park. He reported that skating could start as soon as December 18th. Jerry DelFavero Superintendent of Public Works has been working with Nucor to expedite the process. He also brought along a new sign his department made for the park - “Skating and Music provided by Nucor Steel”. Mayor Lattimore thanked Mr. Smith and Mr. DelFavero.
City Manager’s Report – None
Public to be Heard –
Walt Aikman, Liberty St. – spoke to Council regarding the recent tree planting in November. He thanked all volunteers, and the Rotary Club for all the time and contributions that made everything possible. Mr. Aikman also spoke of the hazards that some of the older species of trees present to the City. He also spoke in support of the ordinance instituting the recycling of cardboard.
Mary Lou Picciano, 32 Cayuga St. spoke to Council about issues she has with the Police Department.
Theresa Zanowich, 11 Dennis St. spoke in opposition to the Individual Residential Alternative Home that will be located on her street.
Ginny Ellis, Owasco, spoke in support of the rights of disabled people. She spoke as the mother of an autistic daughter and advocate for families of disabled people.
Kevin Smith, Executive Director of the Cayuga Seneca ARC, spoke about both the 12 Dennis St. property and the 85 Pulaski St. lot that they are also buying for the same purpose. He gave various facts about the program and goals.
Reports of City Officials – Bill Jacobs reported that he, Chief Quill and Tom Leone attended the Firefighter Training graduation in Binghamton earlier in the day. The City has 3 new firefighters.
Councilor Hunter clarified information he gave at an earlier meeting regarding NYSEG property assessments.
Ordinances
Ordinance #17 of 2005 authorizing amendment to the Code of the City of Auburn at Chapter 254, entitled Solid Waste. Vote: Mayor Lattimore, Councilor Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED
Ordinance #18 of 2005 authorizing amendment to the Code of the City of Auburn at Chapter 104, entitled Animals. Vote: Mayor Lattimore, Councilor Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED
Resolutions
Council Resolution #177 of 2005 authorizing the City Manager to advertise for bids for the purchase of a new ladder truck for the Auburn Fire Department. Vote: Mayor Lattimore, Councilor Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED
Agreement Resolution #178 of 2005 directing the Mayor to notify Seneca Cayuga ARC of the City of Auburn’s approval for the construction and establishment of an Individualized Residential Alternative (IRA) at 85-87 Pulaski Street and 12-14 Shevchenko Avenue, Auburn, New York. Vote: Mayor Lattimore, Councilor Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED
Agreement Resolution #179 of 2005 directing the Mayor to enter into a five (5) year services agreement with David Stathis for computer mainframe and network services for the City of Auburn. Vote: Mayor Lattimore, Councilor Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED
Councilor Dempsey asked for an Executive Session, seconded by Councilor McNabb for the purpose of discussing collective negotiations and the financial history of a particular person. Vote: Mayor Lattimore, no, Councilors Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED Council returned at 7:04PM
Council discussed Agreement Resolution #180 of 2005.
Addendum to agenda – Agreement Resolution #180 of 2005 directing the Mayor to enter into a five year Collective Bargaining Agreement with the Civil Service Employees Association, Inc., Local 1000, AFSCME, AFL-CIO Professional Unit (6251-02) Vote: Mayor Lattimore, Councilor Jacobs - aye, Councilor McNabb – no, Councilors Hunter, Dempsey, aye. CARRIED
Tabled Council Resolution #175 of 2005 authorizing Councils approval of the establishment and operation of an Individualized Residential Alternative home on 12 Dennis St. Vote: Mayor Lattimore, Councilor Jacobs, McNabb, Hunter, Dempsey, aye. CARRIED

Other Business –
In response to Councilor Hunter’s request at a previous meeting, Nancy Hussey, Assistant Corporation Counsel reviewed the issue and laws pertaining to eminent domain.
Acting City Manager Tom Leone asked for Council’s direction regarding replacing freestanding mailboxes that are accidentally hit by city snowplows. By law, the city is immune from claims, but would like to be fair to legitimate citizen requests for replacement. He asked for direction from Council. After discussion, Council asked Mr. Leone to present them with options.
Mr. Leone asked Mr. Lynch, Planning Director to discuss options for addressing IRA home locations as they come up in the future. Mr. Lynch spoke to explain some ideas he and his staff developed in to balance the need for these homes with the needs of the city.
Councilor Jacobs commented on damage done and responsibility for cost when lampposts or city owned fences are hit in motor vehicle accidents. He also commented on recent property transfers listed in the paper. One in particular mentioned was the transfer of 10 single-family homes to one entity.
Mayor Lattimore thanked Judge Mike McKeon for filling in to perform a marriage last week. Mayor Lattimore also mentioned various holiday music events he attended in the City this week.
Mayor Lattimore asked Mr. Leone to ask Adelphia why Auburn senior citizens don’t get a discount from them as other areas do.
Councilor Jacob’s asked Mr. Leone to write an amendment to require trash containers with lids on trash days.
