Roll Call - Councilor Jacobs, McNabb, Hunter, Dempsey, Mayor Carnicelli – Present.

City Staff Present – John Salomone, City Manager; Nancy Hussey, Assistant Corporation Counsel; Debra McCormick, City Clerk, Fire Chief Michael Quill.

Presentations and Proclamations – None

Public Announcements – Clerk read.

Mayor Carnicelli asked Council if they would agree to move the public to be heard ahead in the agenda due to the number of people waiting to be heard.  All agreed.

Public to be Heard –
Linda Leather, 11 Hockeborn Ave and a striking Adelphia employee spoke about the strike and asked for fairness.

Sandy Craner, 90 Hamilton Ave. Executive Director of the Auburn Business Improvement District, spoke in favor of Council Resolution #137 authorizing the Mayor to enter into an agreement with HUD for use of Section 108 Program Loan Authority.

Mary Charles, 26 Logan St. asked Council to have her street swept.

Mike Fallat, Willowbrook Ave. and representative of ADT Security Systems spoke to support Ordinance #14 regarding false alarms.

Susan Hollington, Syracuse, and former Adelphia employee commented on the pension she receives and her hope that fellow striking employees will be able to do the same.

Chuck Mason, 204 Genesee St. – spoke about the Adelphi strike.  He stated the city has the ability to support employees.  He asked that the city investigate potential violations of Adelphia’s contract with the city.

Tim Lattimore, 7 Norman Ave. – reiterated Mr. Mason’s comments and asked the city to look at a municipal cable system.

Pam Jackson, Adelphia employee stated she wants Adelphia to give striking employees a contract.

Greg Brazee, 30 Foxcroft Circle, and Adelphia employee thanked the community for their support and asked for fairness, a contract, pension and health insurance.

Brian Darcy, President of the Labor Council compared corporate America to terrorists and asked for the city’s support for workers.

Mike Whittar, 31 Ross Place, Correction Officer and Grievance Steward spoke in support of the Adelphia employees.

Jack Phillips, 74 S. Main St. Moravia, son in law of an Adelphia worker spoke in support of employees and asked for fairness.

Alan Fedyshyn, 35 Ross St. asked for the City’s support of the employees.

Ron Hill, Teamster Representative Local 118 commented on the strike and asked the company to come back to the table and negotiate.

Mary Ann Chapin, 51 Ross St. asked for support of the workers.

Jack Quinlan Rt. 38A, Owasco, UAW Local 2320 asked the City to support the Adelphia employees.

Mayor Carnicelli asks if anyone else wished to be heard.  None did. She asked if Council would like to comment.  None did. Mayor Carnicelli comments on the strike and stated that the city would do what was best for the city and its citizens.  She then thanked everyone for their comments.

City Manager Report –
The City Manager reported on the following:
§       The electric cars that were donated to the city have arrived.
§       The geothermal project is nearing completion.  The parking lot is being prepared for paving.  Testing of the system will begin next week.  
§       Milling has begun for the streets scheduled for the 2003-04 road programs.  Lake Ave. was the start.

Ordinances
Ordinance #13 of 2003 authorizing amendment to the Code of the City of Auburn at Chapter 285 – Vehicles and Traffic.  VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.

Ordinance #14 of 2003 authorizing an addition of Chapter 227 to the Code of the City of Auburn entitled - Private Security Alarm Systems.  VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.



Resolutions
Award Resolution #133 of 2003 authorizing award of bid for the printing and binding of the 2003 Council Proceedings to The Reporter Company of Walton, New York.  Motion to amend by Councilor McNabb, seconded by Councilor Jacobs.  (amended amount$225. to $295.due to typo).  VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.  Vote on Resolution with amendment:  VOTE: Councilor McNabb, Jacobs, aye, Councilors Hunter, Dempsey, no, Mayor Carnicelli – aye.  PASSED.

Council Resolution #134 of 2003 authorizing the City Manager to advertise for bids for the 2003 Revolving Loan Sidewalk Program. VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.

Change Order Resolution #135 of 2003 authorizing award of Change Order #2 for the 2002 Revolving Loan Sidewalk Program – Phase 2 to Bob Bruno Excavating, Inc., in the amount of $25,000.00, to be charged to Account #HA 5497-440.001. VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.

Sidewalk Resolution #136 of 2003 authorizing the installation of sidewalks on the 2002 Revolving Loan Sidewalk Program – Contract #2, to be charged back to the owner over a five (5) year period and to be charged to Account #HA 5497.440-001. VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.

Council Resolution #137 of 2003 authorizing the Mayor to enter into an agreement with the U.S. Department of Housing and Urban Development (HUD) for use of Section 108 Program Loan Authority and to execute any and all documents necessary for the completion of the HUD Section 108 Loan contracts. VOTE: Councilor McNabb, Jacobs, Hunter, Dempsey, Mayor Carnicelli – aye.  PASSED.

Tabled Legislation - None

Other Business –
Councilor Dempsey clarified his no vote on the award of bid for printing.  He explained that it was just to reinforce his support of local businesses.  He also commented that the new curbing on Dexter Ave. looks great.  Councilor Dempsey also asked for a work session to discuss debris removal issues.

Councilor Hunter commented on the parking situation on narrow streets.  He stated the tight parking on both sides was a concern and asked that it be looked into.

Councilor McNabb commented on the debris removal problem.  He also asked that the south side of the City Hall building be looked at, it appears to be rotting.

Councilor Jacobs asked that that Codes be sent to the lot on Cottage and Seymour St regarding the grass cutting.


Second Public to be Heard
Sam Trinca, Oak St. – commented on the Adelphia strike.

Art Wenzel, 66 South St. thanked the city for their help with the Soap Box Derby especially Tom Weed and Mike Talbot.
