Roll Call - Councilor Jacobs and McNabb, Hunter, Dempsey and Mayor Carnicelli – Present.

Staff Present – John Salomone, City Manager; Tom Leone, Corporation Counsel; Debby McCormick, City Clerk; Beatrice O’Hora, Comptroller; Mike Long, Planner.
Pledge of Allegiance to the Flag- The Saint Alphonsus Boy Scout Troop #3 lead the pledge. They were accompanied by their Scoutmaster, Andy Roche and their families.

City Manager’s Report
The City Manager reported the following:
?       He and Councilor Jacobs attended the New York Conference of Mayors Conference in Albany.  He commented on the proposed pension contribution increase that would mean $1.5 million additional to the city.  He talked with state legislators to see if there would be any help.  The Governor has a plan that may cushion the blow.  Councilor Jacobs recapped his meetings with Senators Hoffman, Nozzolio and Assemblyman Finch.  

Public to be Heard –

Steven John Chermak, 94 Francis St. – stated he did not think council should be considering a resolution regarding a war with Iraq.  He said he supports Prime Minister Blair and President Bush.  He gave council an envelope to keep that contained pictures and print outs from web sites.

Mike Baran 1 Tuxill Square – read a short email regarding Oliver North’s comments in 1987 on Osama Bin Laden.  He asked council to do their homework before voting.

Tim Cutteback, Port Byron – Echoed previous statements and said he wants to see Saddam’s reign end.  

Ken Mochel, 17 Elm St. spoke to council in favor of the resolution opposing war being passed.  He commented on the various reasons that a war with Iraq would affect our community and that is why council should take a stand.

Sam Trinca, Oak St. – spoke to council in favor of going to war with Iraq.

Chris Barrett, Sumner St. – spoke to council in favor of war and opposed to the resolution.

Eva Dehn, Murray St. – spoke of her experience in London as a nurse during World War II.   She said she hoped to never have to see a war again.

Resolutions
Mayor Carnicelli asked Council for consent to bring Resolution #58 up to this time because so many people had come to the meeting in support or against it.  Council discussed the topic and if it should be brought up for a vote.  Councilors Jacobs, McNabb and Dempsey did not want it brought for a vote.  Councilor Hunter and Mayor Carnicelli were in favor of voting.  A majority of council did not want it brought forward and it was not.  Mayor Carnicelli recommended to citizens that they contact Council personally.   She also noted that it was the first time she could remember that a resolution requested by a group of citizens was not voted on.

Council Resolution #49 of 2003 authorizing the City Manager to advertise for bids for the printing and binding of the 2003 Council proceedings. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED.

Council Resolution #50 of 2003 authorizing the Mayor to sign the updated Urban Area Boundaries Map as prepared by the New York State Department of Transportation. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Resolution #51 of 2003 authorizing award to Massa Construction of Geneva, New York for the construction contract at the City’s Intermediate Processing Facility and Recyclable Drop-Off Building.  VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Change Order Resolution #52 of 2003 authorizing Change Order #1 to Massa Construction of Geneva, New York for the construction contract at the City’s Intermediate Processing Facility and Recyclable Drop-Off Building. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Award Resolution #53 of 2003 authorizing award to J&E Electric, Inc., of Auburn, New York for the electrical contract at the City’s Intermediate Processing Facility and Recyclable Drop-Off Building. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Change Order Resolution #54 of 2003 authorizing the Mayor to execute Change Order #1 to J&E Electric, Inc., of Auburn, New York for the electrical contract at the City’s Intermediate Processing Facility and Recyclable Drop-Off Building. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Award Resolution #55 of 2003 authorizing award to All Temp Heating & Air Conditioning of Cicero, New York for the HVAC contact at the City’s Intermediate Processing Facility. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Change Order Resolution #56 of 2003 authorizing Change Order #1 to All Temp Heating & Air Conditioning of Cicero, New York for the HVAC contact at the City’s Intermediate Processing Facility. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Award Resolution #57 of 2003 to Siracusa Mechanical, Inc, of Auburn, New York for the plumbing contract at the City’s Intermediate Processing Facility. VOTE: Councilor Jacobs, McNabb, Hunter, Dempsey and Mayor Carnicelli aye.  PASSED

Tabled Legislation – None

Other Business –
Councilor McNabb commented on the large number of calls he received regarding the resolution on Iraq.

Councilor Jacobs commented on the same situation occurring with him.

Second Public to be heard –
Mr. Cuddeback, Port Byron commented again on the same topic as he did earlier.

Mr. Baran, Tuxill Sq. asked for councilors email address.  He was told they are all on the web site.
