Agenda for September 2, 2014 Meeting

7:00PM Public Meeting:
Chair Kendall opened the meeting at 7PM and appointed Ms. Nelkens to sit for the absent Mr. Giffin. He introduced the ZBA members and explained the Public Hearing procedure.

Public Hearing:
Notice is hereby given that a public hearing will be held at 7:00 PM Tuesday, September 2, 2014 at the Antrim Town Hall on the request of T-Bird Mini Mart (Jay Frazier, agent; James E Robertson, owner)  for a Special Exception (Sign Ordinance - Article XVII, Section F.1. to permit an additional eighteen inches [18”] to the existing free standing sign to accommodate a new diesel fuel price panel) at property located at 1 Concord Street (Tax Map 103, Lot 84), Antrim, NH 03440 in the Village Business District.

Chair Kendall asked Mr. Frazier to present his proposal.

Mr. Frazier stated that the single wall fuel tanks had to be replaced by 2015. His company decided to replace a year early and add diesel fuel which has become very popular. Two tanks (15,000 gallons and  
10,000 gallons) were replaced.

Mr. Frazier said that the existing sign needed to be raised eighteen inches (18”) in order to accommodate the diesel fuel pricing panel. The diesel panel would have the same style as the existing gas pricing panel. With color photographs, he explained the addition to the existing sign.

Public Hearing:
The Public Hearing was opened. Chair Kendall followed the procedure, although, there were no attendees other than Mr. Frazier, representing T-Bird Mini Mart.

Public Hearing closed.

Deliberation:
Chair Kendall clarified the current sign size.

The six criteria for a Special Exception were read.

  • The proposed use may be similar to one or more of the uses already authorized in the district and is an appropriate location for such a use. The additional diesel pricing panel will look just like the existing gas pricing panel.
  • Such approval would not adversely affect the neighborhood, nor otherwise be injurious, obnoxious or offensive. The addition to the sign will not adversely affect the neighborhood.
  • The use will not create excessive traffic congestion, noise, or odors in the neighborhood where it is proposed. The additional pricing panel will not create traffic congestion, noise, or odors.
  • Such approval would be consistent with the intent of the zoning ordinance. The Board members agreed that the proposal was consistent with the zoning ordinance.
  • Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The Board members agreed.
The Board members agreed that all criteria had been met.

Mr. Haggett moved to grant the application of the request of on the request of T-Bird Mini Mart (Jay Frazier, agent; James E Robertson, owner) for a Special Exception (Sign Ordinance - Article XVII, Section F.1. to permit an additional eighteen inches [18”] to the existing free standing sign to accommodate a new diesel fuel price panel) at property located at 1 Concord Street (Tax Map 103, Lot 84), Antrim, NH 03440 in the Village Business District. Mr. Scales seconded the motion.
The following conditions apply to this approval:
Zoning Board of Adjustment requirements, commitments and agreements made by the applicant and/or his agent as recorded in the meeting minutes dated September 2, 2014 and subsequent meetings as they pertain to this application are a conditional part of this approval.
The applicant shall obtain a building permit for any construction or alteration and adhere to all building, health and fire codes.
The applicant shall add eighteen inches (18”) to the current sign in order to include the diesel fuel pricing panel; the existing sigh with the eighteen inch (18”0 addition will not exceed fifteen feet (15’) in height.
