7:15PM Public Meeting

Variances from Article VI. (Residential District) Section C.3.b.1. to permit expansion of a non-conforming structure within the side yard setback; a variance from Article XVI Section C. 1. (Non-conforming structures) property located at 13 West Street (Tax Map 103, Lot 59), Antrim, NH 03440 in the Residential District. The applicant proposes to demolish the existing structure, rebuild on its footprint, and construct an addition on the new structure.

(In order to grant the requested relief, the following criteria must be satisfied: Criteria: 1.Granting the variance would not be contrary to the public interest; 2. The spirit of the ordinance is observed; 3. Substantial justice is done; 4. Value of the surrounding property will not be diminished; 5. Literal enforcement of the provisions of the ordinance would result in an unnecessary hardship.)

Chair Kendall opened the meeting at 7:15PM, introduced himself and members. He explained the procedure for the meeting. The Public Hearing notice was read by the secretary.

Chair Kendall asked the applicant to present his proposal.

Mr. J. Kierstead stated the following:
        Demolish an existing structure
        He would rebuild on footprint
        Existing – 20 x 40  - drew diagram on easel
        Survey would  be done by Forest Designs – Tom Forest

There were questions concerning the non-conforming lot. It was determined that emergency vehicles could get by the new structure. The new building could be centered on the lot. The language within the Notice of Decision would state the exact dimensions. The  existing driveway of 12’ would be a comfortable setback.

Mr.& Mrs. Kemp stated that the house was an eyesore and they would be happy to see it torn down. They were concerned about their driveway. to the right.

Deliberation:

The Board members deliberated the facts of the lot and existing structure. Although, it was realized that it was a “tough” lot, and there was a lengthy discussion, the Board agreed that the new structure would work for the parcel.

Mr. Haggett moved to approve the application of the request of Jaimie Kierstead (owner of parcel is Nancy Kierstead) for variances from Article VI. (Residential District) Section C.3.b.1. to permit expansion of a non-conforming structure within the side yard setback; a variance from Article XVI Section C. 1. (Non-conforming structures) property located at 13 West Street (Tax Map 103, Lot 59), Antrim, NH 03440 in the Residential District. Mr. Scales seconded the motion.
The following conditions apply to this approval:
Zoning Board of Adjustment requirements, commitments and agreements made by the applicant and/or his agent as recorded in the meeting minutes dated October 22, 2013 and subsequent meetings as they pertain to this application are a conditional part of this approval.
The applicant shall obtain a building permit for any construction or alteration and adhere to all building, health and fire codes.
Replace on existing footprint with a 20’ wide structure

Business Meeting:       

Approve Minutes of August 13, 2013  Mr. Haggett move to approve the minutes as presented. Mr. Giffin seconded. On a voice vote, the Board moved to accept the minutes as presented.

At 9:10 PM, Mr. Haggett moved to adjourn; Mr. Giffin seconded. All approved. The meeting was adjourned.
