August 13, 2013 Meeting
Public Hearing Seavey Variances Case #2013-03ZBA

Request of Richard & Diane Seavey for variances from Article VI. (Residential District) Section C.3.a.b.c.  to permit expansion of an existing non-conforming structure within the front yard, side yard and rear yard setbacks; a variance from Article XVI Section C. 1. (Non-conforming structures) property located at 10 Wallace Street (Tax Map 102, Lot 42), Antrim, NH 03440 in the Residential District.

Ms. Nelkens recused herself.

The Public Notice was read by the Secretary. All abutters had been properly notified with certified mail.

The procedure was explained to the public attendees.

Mr. Seavey presented his proposal:
  • A two story addition with full basement
  • Two locations were described
  • Similar to other structures on the street
  • He stated how the proposal met the 5 criteria for the variance
  • By denying the variance a hardship would be created for the Seavey family
  • He wanted generational living – a lasting impact for their children and grandchildren
Chair Kendall questioned the dimensions of the proposed addition.

Mr. Seavey stated that the site work for the barn was considerably less than the other possible location and that he preferred to build where the barn had been located.
        
Mr. Ledgerwood asked if Mr. Seavey had spoken with his neighbors.

Mr. Seavey stated that he had and there were no objections.     

Chair Kendall stated that there should be two separate votes for what he saw as two separate variances – one for the rear yard setback and one for the side yard setback.

Ms. Ogilvie stated that a variance is definitely needed.

Chair Kendal clarified the options by demonstrating – through a drawing on the easel. Two options:

  • Barn extension – 40’ x 18’ and two stories – in the rear yard setback
  • A 30’ x 25’ addition with a 6’ breezeway in the side yard setback
The Kendall diagram will become a part of the permanent record.

A lengthy discussion about setbacks and the proposed addition possibilities occurred.

Public Hearing:

Chair Kendall asked for comments from abutters in favor or not in favor of the proposal.

Deborah Drumm wanted further clarification.

Ms. Nelkens questioned the impact on value of her property with her cabin.

Deliberation:

Chair Kendall stated that Option # 2 (a new addition on its own foundation) would have the least amount of impact on the surrounding properties. Option #1 (former barn footprint) was on the property line, creating numerous difficulties during the building process (as an example, construction equipment may need to work from abutters’ land); and future maintenance of the addition (e.g. – constructing a new roof).

The discussion continued as the board members weighed the options of the two proposed additions.

After a lengthy discussion of the options and a suggestion by Ms. Ogilvie, Mr. Seavey withdrew his request for Option #1 in the rear yard setback.

Deliberation was closed.

Mr. Haggett moved to approve the application of the request of Richard & Diane Seavey for variances from Article VI. (Residential District) Section C.3. a.  to allow the construction of a structure within the front yard setback (aka Option # 2) on  property located at 10 Wallace Street (Tax Map 102, Lot 42), Antrim, NH 03440 in the Residential District. Mr. Scales seconded the motion.
The following conditions apply to this approval:
Zoning Board of Adjustment requirements, commitments and agreements made by the applicant and/or his agent as recorded in the meeting minutes dated August 13, 2013 and subsequent meetings as they pertain to this application are a conditional part of this approval.
The applicant shall obtain a building permit for any construction or alteration and adhere to all building, health and fire codes.
A two-story structure not to exceed 1200’ square feet on the first floor
Not to be constructed  any closer to Wallace St than the existing structure

Business Meeting:       

Approve Minutes of May 28, 2013

Mr. Haggett moved to accept the minutes as presented. Mr. Scales seconded. The minutes were unanimously approved.

At 9:00PM, Mr. Haggett moved to adjourn; Mr.  Scales seconded. All approved. The meeting was adjourned.
